In The Event Of Non-Presentation Of The Performance Guarantee Within The Term Specified By The Contracting Authority, Without The Existence Of Objective Reasons, The Contract Shall Be Terminated. When, After The Expiration Of A 3-Month Period From The Conclusion Of The Contract, Financing Is Not Provided, Either Party May Request Its Termination Without Notice. When, After The Expiration Of 10 Months From The Conclusion Of The Contract, Financing Is Not Provided, The Contract Is Considered Terminated. The Contracting Authority Makes A 100% Advance Payment Of The Value Of The Medical Equipment, Within 30 /Thirty/ Days, Counted From The Date Of The Sent Notification Letter For A Secured Target Financial Resource And After Presentation By The Contractor Of The Following Documents: An Invoice, A Guarantee Guaranteeing The Full Amount Of The Advance Payment And A Performance Guarantee. The Guarantee Securing The Advance Payment, In The Amount Of The Advance Payment Incl. Vat Is Submitted In One Of The Forms Specified In This Documentation. The Guarantee Securing The Advance Payment Is Released Within 3 (Three) Days After The Return Or Utilization Of The Advance. The Advance Is Considered To Have Been Used After The Signing Of The Following Documents: Acceptance-Handover Protocol For The Delivery Of The Medical Equipment, With All Kits, Certificates, Permits And Instructions For Storage And Operation, Signed By Both Parties Or Persons Authorized By Them, On The Date Of Delivery; Protocol For Installation, Commissioning And Completed Training Of Specialists For Working With The Medical Equipment, Signed By Both Parties Or Persons Authorized By Them, On The Date Of Commissioning.
