Diesel Fuel (En 590) – Successful Delivery Of Diesel Oil. 1. The Subject Of The Order Is The Successive Supply Of Diesel Oil To The Municipal Transport Company In Piła (Hereinafter Referred To As Mzk Piła) In The Period From January 1, 2027 To December 31, 2027 In A Total Amount Of 600,000 Liters. 2. The Offered Diesel Oil Must Meet The Requirements Contained In The Regulation Of The Minister Of Economy Of October 9, 2015 On Quality Requirements For Liquid Fuels And The Current Standards: Pn-En 590 (Journal Of Laws Of 2023, Item 1314, As Amended). 3. The Ordering Party Requires That In The Offered Supply The Share Of Diesel Oil Coming From European Union Member States Or Countries With Which The European Community Has Concluded Agreements On Equal Treatment Of Entrepreneurs Exceeds 50% (In Value Terms). 4. The Ordering Party Requires That The Offered Diesel Oil: 4.1 Have A Cetane Number Of Not Less Than 51, 4.2 Have A Sulfur Content Of Not More Than 10 Mg/Kg. 5. At The Request Of The Ordering Party, During The Winter Period, The Contractor Is Obliged To Provide Diesel Oil With Improved Low-Temperature Properties (Cold Filter Blocking Temperature, Cloud Point). 6. The Offered Diesel Oil Must Meet Currently Applicable Standards Throughout The Duration Of The Contract. If The Applicable Quality Standards Change During The Term Of The Contract, The Contractor Will Adjust The Quality Of Fuels To The New Standards. 7. Terms Of Execution Of The Subject Of The Order: 7.1 Diesel Oil Will Be Delivered To The Registered Office Of The Ordering Party, Located At Ul. Północna 4 In Piła, At The Expense And Risk Of The Contractor, By Road Tankers, From Monday To Saturday, From 7:00 A.M. To 10:00 A.M., Based On The Order Placed By The Ordering Party (Electronically). 7.2 The Maximum Delivery Time, Counted From The Moment Of Placing The Order, Is 24 Hours. 7.3 The Ordering Party Does Not Expect To Place Orders On Saturdays. 7.4 The Contractor Will Attach Proof Of Filling Or Dispensing To Each Delivery, Together With A Current Quality Certificate (Laboratory Certificate) For A Given Batch Of Diesel Fuel. 7.5 The Ordering Party Reserves The Right To Carry Out A Quality Inspection Of The Supplied Diesel Oil Once A Year At The Contractors Expense. Sampling Will Take Place In The Presence Of An Authorized Representative Of The Contractor. The Analysis Will Be Performed By A Laboratory Agreed By The Parties. 7.6 In Case Of Doubts As To The Quality Of The Delivered Fuel (After Prior Notice To The Contractor), The Ordering Party May Order, At The Contractors Expense, Testing Of A Sample Of This Supply In An Independent Laboratory. The Laboratorys Decision, Made In Writing With Justification, Will Be Final And Binding On The Parties. The Contractor Will Bear The Cost Of Testing If The Oil Is Found To Be Of Inappropriate Quality. The Analysis Cannot Be Performed By The Entity That Issued The Quality Certificate Provided Upon Delivery. 7.7 A Discrepancy Consisting In Non-Compliance Of The Parameters Of A Fuel Sample From A Given Delivery With The Parameters Resulting From The Manufacturers Quality Certificate Provided, Confirmed By A Laboratory Test, Will Be Considered As A Non-Compliant Delivery.
