The Subject Of The Order Is The Purchase Of 11 Pieces Of Power Generators, The Purchase Of 11 Pieces Of Cargo Trailers (Two-Axle) - As Part Of The Implementation Of The Task Titled Creating And Maintaining, Within The Commune, Civil Protection Resources And Infrastructure Necessary For The Implementation Of Civil Protection And Civil Defense Tasks (Investment Tasks, Second Recruitment). The Subject Of The Contract Delivered To The Ordering Party Will Be Brand New, Free From Legal And Manufacturing Defects And Will Be In Accordance With The Recommendations, Standards And Applicable Technical And Operational Requirements In The Territory Of The Republic Of Poland. Delivery Of The Subject Of The Contract Will Take Place In The Place Indicated By The Ordering Party In The Brzeszcze Commune. From The Activities Upon Acceptance, The Representatives Of The Parties Will Prepare An Acceptance Protocol. Before Signing The Protocol, The Contractor Is Obliged To Provide The Ordering Party With Technical And Operational Documentation Or Operating Instructions In Polish. The Acceptance Of The Subject Of The Contract Will Consist In Checking The Condition Of The Subject Of The Contract And Confirming The Completeness Of The Equipment And Fittings. If During The Acceptance, Defects, Defects And Deficiencies That Cannot Be Removed Are Found, The Ordering Party May Refuse To Accept The Subject Of The Contract In Whole Or In Part Affected By These Defects, Defects Or Deficiencies, Specifying The Deadline For Their Removal. In This Case, The Uncollected Subject Of The Contract Will Be Indicated, With An Indication Of The Deadline For Delivery Of The Subject Matter Of The Contract, Free Of Defects, Faults And Shortcomings, Not Longer Than 7 Calendar Days. In Such A Situation, The Contractor Is Deemed To Be In Default With The Performance Of The Contract And Is Obliged To Pay The Contractual Penalties Referred To In § 7(2)(B) Of The Contract Template, If The Deadline Specified In Section 1 Has Been Exceeded Above. If Defects, Faults And Deficiencies That Can Be Removed Are Found During Acceptance, The Ordering Party Will Set A Deadline For The Contractor To Remove Them. After The Contractor Has Removed The Defects, Faults And Deficiencies That Can Be Removed At His Own Expense, The Contractor Will Notify The Ordering Party Of Their Removal, And The Ordering Party Will Carry Out The Acceptance After Confirming Proper Performance. The Cost Of Transport And Insurance During Transport Is Borne By The Contractor.
