1. Subject (Name) Of The Order: Expansion Of The School And Kindergarten Complex With A Kindergarten Section In Mściszewice. The Order Is Implemented As Part Of The Project Creating Permanent Places For Pre-School Education And Improving The Quality Of Pre-School Education In The Sulęczyno Commune, As Part Of The European Funds For Pomerania 2021-2027 Program.2.Procedure Number: Irk.271.1.17.2026.3.A Detailed Description Of The Order Is Included In The Design Documentation - Annex A To Swz.4.The Execution Of The Subject Of The Order Must Be In Accordance With These Terms Of Reference (Hereinafter Referred To As: Swz) And The Annexes To The Swz As Well As Applicable Legal Regulations. Attention!!! The Bill Of Quantities Is Of An Auxiliary Nature In Relation To The Designs And Technical Specifications, And Serves The Contractor To Properly Calculate The Price Of His Offer. The Ordering Party Will Settle With The Contractor A Lump Sum For The Execution Of The Order. The Contractor Will Be Obliged To Obtain A Valid Occupancy Permit In Accordance With The Content Of The Building Permit Decision.5.In The Offer Form, The Contractor Will Prepare A Material And Financial Schedule In Accordance With Which The Subject Of The Agreement Will Be Implemented, On The Following Principles: A) When Planning The Time Needed To Perform Individual Types Of Works, The Contractor Will Take Into Account Waiting Times For The Delivery Of Materials And Equipment, In Such A Way As To Guarantee Completion Of The Works Within The Time Specified In The Contract; B) The Works In The Schedule Should Be Planned In Such A Way That By The Date Specified In § 2 Section 2 Of The Contract, All Works Will Be Performed And The Works Will Be Fully Completed, Acceptance Documentation Will Be Completed And Handed Over To The Ordering Party, Readiness For Final Acceptance Confirmed By The Contractors Written Notification And Entries In The Construction Log; C) If The Actual Progress Of The Works, For Reasons Attributable To The Contractor, Objectively Threatens The Completion Date Of The Works Or The Contractor, For Reasons Attributable To Him, Will Not Meet The Deadlines Specified In The Material And Financial Schedule Or There Will Be Other Significant Deviations From The Schedule Material And Financial, The Contractor, At The Request Of The Ordering Party, Will Immediately, And No Later Than Within 7 Working Days, Submit A Draft Recovery Program To The Ordering Party For Approval; D) The Recovery Program Should Provide For The Reorganization Of The Method Of Performing Works By Increasing The Involvement Of Equipment, Personnel, Subcontractors Or Financial Resources Of The Contractor In Order To Perform Works That Have Not Yet Been Completed And Complete The Task Within The Contractual Deadline. The Contractor Is Not Entitled To Additional Remuneration For This.
