A Detailed Description Of The Subject Of The Order Is Described In The Swz And In Annex No. 1 - Offer Form.1. The Subject Of The Order Will Be Implemented Successively In The Range And Quantities Resulting From The Demands Placed Directly By The Ordering Party.2. The Prices Given In The Offer Will Be Fixed For The Duration Of The Contract, Subject To Changes In Vat Rates Based On Applicable Legal Provisions In This Regard. The Amount Of Vat Will Change, And Therefore The Gross Price, While The Net Price Will Remain Unchanged.3. The Estimated Quantity Of Demand For Products Given In The Swz And In The Offer Form Is Not A Fixed Quantity And May Be Increased Or Decreased According To The Needs Of The Ordering Party. 4. The Ordering Party May Unilaterally Increase The Size Of The Subject Of The Order By A Maximum Of 9.99% Of The Value Of The Contractors Offer Price. For This Reason, The Contractor Is Not Entitled To Any Claims Against The Ordering Party, Including Damages. The Ordering Party Will Inform The Contractor About Exercising This Right Before Exceeding The Contract Value Specified In § 5 Section 2 Contracts. 5. The Parties Jointly Declare And Agree That 1) The Ordering Party May Exercise The Right To Increase The Size Of The Subject Of The Order Many Times, Until The Maximum Value Specified In Section 4;2) The Ordering Partys Right To Increase The Size Of The Subject Of The Order Is Its Right, Not An Obligation, Which Means That The Ordering Party May Not Exercise The Option Right In Whole Or In Part, And The Contractor Is Not Entitled To Any Claims In This Respect.6. If The Ordering Party Exercises The Right To Increase The Size Of The Subject Of The Order, The Contractor Is Obliged To Implement It Under The Conditions Specified In This Agreement.7. The Ordering Party Determines The Minimum Size Of The Subject Of The Order That Will Be Completed At The Level Of At Least 30% Of The Value Of The Contractors Offer Cent. For This Reason, The Contractor Is Not Entitled To Any Claims Against The Ordering Party, Including Damages. In Such A Case, The Contractor Will Receive Remuneration For The Completed Part Of The Contract. 8.
