The Subject Of The Order Is The Delivery Of A Commodity /Heating Fuel/, Which Is Traded On The Commodity Exchange. According To Art. 79, Para. 1, Item 7 Of The Public Procurement Act, Contracting Authorities May Award Public Contracts Through A Negotiation Procedure Without Prior Announcement, When The Subject Of The Contract Is The Supply Of Goods That Are Traded On A Commodity Exchange, According To A List Approved By An Act Of The Council Of Ministers, On The Proposal Of The Minister Of Finance. The Choice Of A Negotiation Procedure Without Prior Notice In The Present Case Is Conditioned By The Fact That The Goods, The Subject Of The Present Order, Are Included In The List Of Goods Under Art. 79, Para. 1, Item 7 Of The Zop According To Decree No. 191/29.07.2016 Of The Council Of Ministers, Amended By Pms No. 347/8.12.2016, Promulgated In No. 99/13.12.2016 Of The Official Gazette. The Subjects Of Public Procurement Can Supply The Goods Traded On Commodity Exchanges And Listed In Resolution No. 191 Of The Council Of Ministers Of 2016, Through A Stock Exchange Transaction On The Basis Of Article 79, Paragraph 1, Item 7 Of The Public Procurement Act. In This Case, The Contract For Public Procurement Is Concluded On The Commodity Exchange Of A Separate Stock Exchange Circle In Accordance With The Law On Commodity Exchanges And Markets (Zsbt). The Contracting Authority Has Chosen Sofia Commodity Exchange Jsc And Has Entered Into A Contract For Stock Exchange Representation With Its Member, And The Delivery Contract Has Been Concluded According To The Rules Of The Said Stock Exchange.
