1. The Subject Of This Contract Is The Purchase And Delivery Of Summer And Winter Diesel Oil By Tanker To The Ordering Partys Warehouse In Gubin At Ul. Śląska 36 In A Total Maximum Quantity Of Up To 120,000 Liters.2.The Expected Amount Of Fuel Is A Maximum Value And Is An Estimate. The Actual Amount Of Diesel Fuel Delivered Will Depend On The Current Needs Of The Ordering Party. The Total Value Of The Remuneration Will Result From The Actual Amount Of Diesel Oil Delivered. Due To The Limitation Of The Subject Matter Of The Contract By The Ordering Party, The Contractor Will Not Be Entitled To Any Claims Against The Ordering Party.3.The Parameters Of The Delivered Diesel Oil Will Be Adjusted To The Delivery Period, I.E. Season And Ambient Temperature (So-Called Summer And Winter Diesel Oil).4.The Subject Of The Order Includes The Supply Of Diesel Oil Referred To In Point 3.2. Swz In The Period From January 1, 2027 To December 31, 2027 Or To Order The Maximum Amount Of Fuel Referred To In Point 3.2 Of The Swz, Whichever Comes First. 5. Additional Requirements Regarding The Subject Of The Order: 5.1.The Ordering Party Requires That The Supplied Diesel Oil Complies With The Requirements Specified In The Regulation Of The Minister Of Climate And Environment Of June 26, 2024 On Quality Requirements For Liquid Fuels (Journal Of Laws Of 2024, Item 1018, As Amended) And Polish And European Standards, Including Pn-En 590 (Or The Latest Standard In Force On The Date Of Delivery). Replacing It) And Applicable Legal Provisions In This Regard Or Equivalent Fuel. By Equivalent Fuel, The Ordering Party Understands Fuel With Physicochemical And Functional Properties Not Worse Than Those Specified In The Above-Mentioned Standard, Which Fully Meets The Quality Requirements Specified In The Above-Mentioned. Regulation. 5.2.Transport And Unloading In Order To Perform The Subject Of The Order Is The Responsibility Of The Contractor And Should Be Carried Out In Accordance With Applicable Law In The Scope Of: European Agreement Concerning The International Transport Of Dangerous Goods By Road Adr (Journal Of Laws Of 2021, Item 874, As Amended), The Act On The Transport Of Dangerous Goods (Journal Of Laws Of 2024, Item 643) And The Act On Road Transport (Journal Of Laws Of 2025, Item 1490).5.3.The Contractor, On Behalf Of The Ordering Party, Will Register The Transport Of Diesel Fuel Via The Puesc Electronic Tax And Customs Services Platform. 3.6.4.With Each Delivery To The Ordering Party, The Contractor Will Submit Quality Certificates For A Given Batch Of Fuel And A Release Document Prepared On The Basis Of Measurements Of The Fuel Released From The Contractors Warehouse And Containing Data On Its Temperature, Density And Volume Measured In M3 And Volume At The Reference Temperature Of +15°C. 5.5.Any Discrepancies Between The Volume Of Fuel Declared By The Contractor In The Release Document And The Volume Of Fuel Accepted Into The Ordering Partys Tank Will Be Confirmed
