1. The Subject Of The Order Is The Delivery Of Various Drugs According To 15 Packages (Including Drugs Used In Chemotherapy) To The Headquarters Of The Ordering Party (Kraków, Os. Złotej Jesieni 1), In Accordance With The Description And Requirements Contained In Annex No. 1 To These Specifications. Package 14 - Fsmp - Food For Special Medical Purposes.2.Validity/Warranty Period Of The Subject Of The Order: Cannot Be Shorter Than 12 Months From The Date Of Delivery. Deliveries Of Products With A Shorter Expiry Date May Be Permitted In Exceptional Situations And Each Time Consent Must Be Given By An Authorized Representative Of The Ordering Party With Confirmation Via E-Mail.3.For Nutritional Preparations, The Ordering Party Allows An Expiration Date Shorter Than 12 Months, But Not Shorter Than 6 Months.4.Only Drugs Included In The National Health Funds Reimbursement Lists Are Allowed In Drug And Chemotherapy Programs (The Price Of The Drug Cannot Exceed The Financing Limit Set By The National Health Fund).5.The Ordering Party Should Include The Form Of The Drug In The Specification, E.G. Tablet. Means All Types Of Pills, And Caps. – All Types Of Capsules, Etc. In Other Cases, The Form Of The Drug Is Precisely Specified, E.G. Enteric Tablet Means That Only Enteric Tablets Are Allowed.6.For Medicines In The Form Of Tablets Or Capsules, The Ordering Party Requires Immediate Packaging In The Form Of Blisters, If The Medicinal Product Is Available In This Type Of Packaging.7.For Medicines Packaged In Drops, The Ordering Party Requires The Number Of Drops In The Offered Volume Of The Unit Packaging.8.A Medicinal Product Constituting The Subject Of The Order Should Be Understood As Medicinal Products Within The Meaning Of The Pharmaceutical Law Act Of September 6, 2001 (Consolidated Text: Journal Of Laws Of 2025, Item 750, As Amended). The Offered Medicinal Product Must Be Authorized For Marketing Under The Terms Set Out In Art. 3 Or 4 Section 1 And 2 Or 4A Of The Pharmaceutical Law.9.The Offered Foodstuffs For Particular Nutritional Uses Constituting Part Of The Subject Of The Order Must Meet Appropriate Requirements And Be Admitted To Trading On The Terms Specified In Particular In The Provisions Of The Act Of August 25, 2006 On Food And Nutrition Safety (Consolidated Text: Journal Of Laws Of 2023, Item 1448, As Amended) And Implementing Acts, Including The Regulation Of The Minister Of Health Of September 16, 2010 On Foodstuffs Intended For Particular Nutritional Uses (Consolidated Text: Journal Of Laws Of 2015, Item 1026)10.The Ordering Party Allows The Participation Of Authorized Subcontractors In The Implementation Of This Order In The Part Concerning The Transport Of The Medicinal Product To The Ordering Partys Headquarters.11.The Remaining Terms Of The Order Are Specified In The Draft Contract Constituting Annex No. 3 To The Specification.
