1. The Subject Of The Order Is The Construction Of An Access Road To Agricultural Land On Plot No. 3642 In The City. Ogrodzieniec And Plot No. 1504 In Msc. Podzamcze, Including: A) Construction Of A Road With An Asphalt Surface And Substructure; B) Construction Of Roadsides With A Surface Made Of A Mixture Not Related To Aggregate.2.A Detailed Description Of The Subject Of The Order Is Set Out In Annex No. 4 To The Swz - Design Documentation And Designed Provisions Of The Contract.3.The Contractor Will Provide The Ordering Party With A Quality Guarantee And Warranty For Defects On Completed Construction Works And Incorporated Materials For A Period Of 60 Months From The Date Of Signing The Final Acceptance Protocol.4.In Each Case When The Description Of The Subject Of The Contract Contains References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, The Ordering Party Allows Solutions Equivalent To Those Described. When Analyzing The Documentation, The Contractor Should Assume That Each Such Reference Is Accompanied By The Words Or Equivalent.5.If Trademarks, Patents, Origins, Sources Or Specific Processes Are Used In The Documents, It Means That They Are Provided As Examples And Only Specify The Minimum Expected Quality And Functional Parameters And The Required Standard. The Ordering Party Allows The Use Of Equivalent Materials Or Devices, I.E. Those Whose Technical, Qualitative And Operational Parameters Are No Worse (At Least The Same Or Better) Than Those Indicated In The Description Of The Subject Of The Order, And Their Use Will In No Way Adversely Affect The Proper Functioning Of The Solutions Adopted In The Documentation. A Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate In The Offer That The Solutions Proposed By Him Equally Meet The Requirements Specified In The Description Of The Subject Of The Order (E.G. By Submitting With The Offer A List Of Equivalent Solutions And Appropriate Means Of Evidence, Such As Manufacturers Catalog Cards). If The Contractor Does Not Submit A List Of Equivalent Solutions With The Offer, The Ordering Party Will Assume That The Contractor Has Offered Reference Materials And Devices, Strictly Indicated By The Ordering Party In The Design Documentation.6.The Use Of A Label In The Documents Provided Means That The Ordering Party Accepts All Labels Confirming That Given Construction Works, Supplies Or Services Meet The Equivalent Requirements Of The Label Specified By The Ordering Party.
