Tenders Are Invited For Delivery Of Dental Materials For Fillings

1. The Subject Of The Order Is The Supply Of Dental Materials For Fillings, Part No. 1 - Fillings I2.The Ordering Party Allows The Submission Of Partial Offers (For Individual Parts Of The Order). Each Contractor May Submit An Offer For One Or More Parts. One Contractor May Submit An Offer For All Parts Of The Order Specified In Annex No. 2 - In The Product And Price Form. It Is Not Allowed To Submit Offers That Do Not Cover All Items Of A Given Part Of The Order3.The Offered Products Must Be Medical Devices Delivered As Brand New In Original Sealed Packaging, In A Condition Suitable For Use As Intended And Approved For Trading And Use In Poland In Accordance With The Act Of April 7, 2022 On Medical Devices And The Regulation (Eu) 2017/745 Of The European Parliament And Of The Council Of April 5, 2017 On Medical Devices, Amending The Directive 2001/83/Ec, Regulation (Ec) No. 178/2002 And Regulation (Ec) No. 1223/2009 And Repealing Council Directives 90/385/Eec And 93/42/Eec (Mdr) And Implementing Acts, Comply With Legal Requirements And Meet The Required Standards Enabling Their Intended Use. The Contractor Declares That The Subject Of The Order Has All The Necessary Certificates, Attestations Or Approvals Of Relevant Offices And That It Is Free From Defects.4.A Detailed Description Of The Subject Of The Order Along With Quantities Is Included In Annex No. 2. Assortment And Price Form To The Swz. This Description Should Be Read Together With Any Changes To The Content Of The Specification, E.G. As A Result Of Responses To Contractors Inquiries. The Given Quantities Are The Estimated Demand For The Duration Of The Contract And Are Used To Calculate The Offer Price (I.E. Determine The Contractors Maximum Remuneration). 5. If Trademarks, Patents Or Origin, Source Or A Specific Process That Characterizes Products Or Services Provided By A Specific Contractor Are Used In The Swz And Its Annexes, In The Description Of The Subject Of The Order, The Ordering Party Allows Equivalent Solutions In Accordance With The Public Procurement Law. Equivalent Products Are Products With The Same Composition And Dosage As The Reference Product.6.The Ordering Party Reserves The Right Not To Use The Maximum Amount Of Remuneration And, Consequently, To Reduce The Maximum Value Of The Subject Of The Agreement By 40%. Therefore, The Minimum Value Of The Benefit From The Ordering Party In The Event Of Offering Goods In Accordance With The Requirements Of The Swz And The Contract Is 60% Of The Maximum Value Of The Subject Of The Agreement. The Ordering Party Will Not Bear Any Negative Financial Consequences Caused By Such A Reduction, And The Contractor Has No Claims Against The Ordering Party In This Respect.7.The Contractor Will Deliver The Subject Of The Order Using A Specialized Means Of Transport, In Accordance With Applicable Regulations And Standards, In A Manner That Does Not Adversely Affect The Usefulness And Functional And Quality Values, At His Own Expense, With
