Tenders Are Invited For Legal Advisory Services For The Implementation Of The Battery Booster Facility

Planned call for tenders: Legal Advisory Services for the Implementation of the Battery Booster Facility. Description: The European Commission is implementing the Battery Booster Facility, a EUR 1.5 billion zero-interest loan facility established under Pillar 1 of the Battery Booster Strategy. The Facility aims to accelerate the ramp-up of battery cell manufacturing capacity in the European Economic Area, strengthen the Unions strategic autonomy and industrial competitiveness, and support the objectives of the Green Deal Industrial Plan, the Net-Zero Industry Act and the Clean Industrial Deal. The Facility will be implemented under direct management by the Commission through a competitive call for proposals. The Commission will remain solely responsible for the evaluation, selection and award decisions, as well as for the negotiation, signature, implementation, monitoring and financial management of the financing operations. Given the complexity of these loans, the Commission requires high-quality specialized legal expertise to support the preparation, negotiation and implementation of the loan agreements with the selected beneficiaries from the EU and EEA, as well as all related agreements. This specialised legal services will ensure that the legal documentation related to the loans and the related agreements or arrangements (i) protect the interests of the Union, including its financial interests; (II) comply with the applicable Union legal framework; (iii) comply with governing law of the loan agreement which will be Union law complemented by Luxembourg law, (iv) comply with tax law of the beneficiaries and Luxembourg, and (v) comply with the applicable national law, including national civil/contract law.
