The Municipality Of West Betuwe Is Looking For A Market Party That Will Buy A Plot At De Strobbel In Herwijnen And Build Four Owner-Occupied Homes At Its Own Expense And Risk. The Municipality Is Responsible For Preparing And Constructing The Future Public Area And The Market Party For The Realization Of The Homes. This Selection Guide Describes The Selection And Award Criteria And The Timeline To Be Followed. The Aim Is To Select One Market Party Through A Public Procedure That Submits An Appropriate Plan And Makes A Bid For The Land Position. The Municipality Selects The Party That Realizes This At Its Own Expense And Risk And Offers The Best Price-Quality Ratio (Bkpv). This Publication Serves To Ensure A Transparent, Objective And Non-Discriminatory Selection Procedure. The Public Procurement Act 2012 Does Not Apply To This Issue, As It Is Not A Government Contract Within The Meaning Of This Law, But A Private Law Issue Governed By The Didam Case Law (Supreme Court 26 November 2021, Ecli:Nl:Hr:2021:1778). No More Than Four Weeks After The Final Award, The Municipality Of West Betuwe Will Conclude A Purchase-Realization Agreement For The Land Position With The Winning Party (Appendix B3). The Delivery Of The Land Ready For Construction Takes Place Under The Same Conditions As Included In The Purchase-Realization Agreement. Delivery Of The Land Takes Place No Later Than 9 Months After Signing The Purchase-Realization Agreement.
