The Subject Of The Order Is The Purchase By The Agency For Restructuring And Modernization Of Agriculture With Its Registered Office In Warsaw (Hereinafter Referred To As The Ordering Party Or Arimr) Of It System Maintenance And Development Services. The Contractor Will Provide The Ordering Party With Services Divided Into The Following Groups Of Services: 1.1. Group Of Environmental Maintenance Services (G1), Described In Detail In Annex No. 1 To The Draft Provisions Of The Contract (Hereinafter Referred To As P.P.U.), Constituting Annex No. 10 To The Terms Of Reference (Hereinafter Referred To As Swz), Including: 1.1.1. Environmental Administration Service (G1u1), Described In Detail In Annex No. 1A To The Environmental Protection Act; 1.1.2. Availability And Performance Monitoring Service (G1u2), Described In Detail In Annex No. 1B To The Labor Code; 1.1.3. Installation Service (G1u3), Described In Detail In Annex No. 1C To The Labor Code; 1.2. Quality Assurance Services Group (G2), Described In Detail In Annex 2 To The Labor Code, Including: 1.2.1. Defect Removal Service (G2u1), Described In Detail In Annex No. 2A To The Labor Code; 1.2.2. Code And Documentation Management Service (G2u2), Described In Detail In Annex No. 2B To The Labor Code; 1.2.3. Integration And Certification Service (G2u3), Described In Detail In Annex No. 2C And 2C1 To The Labor Code; 1.3. It System Administration Services Group (G3), Described In Detail In Annex No. 3 And 3A To The Ipl. 1.4. Development (Modification) Services Group (G4), Described In Detail In Annex No. 4 And 4A To The Labor Code. 1.5. Regardless Of The Above Groups Of Services, The Contractor Is Obliged To: 1.5.1. Providing The Operational Orders Service, Described In Detail In Annex 5 To The Labor Code; 1.5.2. Implementation Of Activities Planned For The Transitional Period, Described In Detail In Point 6 Of The Labor Law. And Annex No. 7 To The Labor Code; 1.5.3. Implementation Of Activities Envisaged For The Transfer Of Services, Described In Detail In Point 15 Of The Labor Law. 2. The Contractor Will Accept Notifications Within Response Times (In Accordance With The Scope Described In Point 2 Of Annex No. 9 To The Labor Agreement) And Will Ensure The Management Of The Contractors Design Office In Accordance With The Scope Described In Point 3.43 Of Annex No. 13 To The Labor Law. 3. The Ordering Party Requires The Contractor Or A Subcontractor To Employ, Under An Employment Contract, Persons Performing The Activities Referred To In Point 2, Due To The Fact That The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code. All Persons Performing The Activities Indicated In Point 2 Should Be Employed Throughout The Entire Order Execution Period. 4. The Ordering Party Requires That The Contractor, Within 15 Business Days From The Date Of Signing The Agreement And Within 10 Business Days Of The First Month Of A Given Calendar Quarter Throughout The Entire Period Of Implementation Of The Agreement, Submit To The Ordering Party A Declaration On The Method Of Employment Of Persons And The Activities Performed By Them, Referred To In Point 2. In Order To Verify The Employment By The Contractor Or Subcontractor Under An Employment Contract Of Persons Performing The Persons Indicated By The Contractor.
