The Subject Of The Order Is The Provision Of A Service Consisting In Establishing And Running A Selective Municipal Waste Collection Point In The Kluczbork Commune. The Selective Municipal Waste Collection Point, Hereinafter Referred To As Pszok, Will Be A Place Of Collection And Temporary Storage Of Separately Collected Waste, Delivered By Owners Of Real Estate Covered By The Municipal Waste Management System, I.E. Real Estate: 1) Where Residents Live, 2) Of A Mixed Nature, I.E. In Part Inhabited And In Part Of Real Estate Where No Residents Live And Municipal Waste Is Generated. 2. Waste Collected At Pszok Will Be Transferred For Management To Waste Recovery Or Neutralization Installations, In Accordance With The Hierarchy Of Waste Management Methods Referred To In Art. 17 Of The Act Of December 14, 2012. On Waste (Journal Of Laws Of 2023, Item 1587, As Amended) The Description Of The Subject Of The Order Is Attached As Annex No. 1 To The Agreement. 3. If References To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Are Indicated In The Procurement Documents, The Ordering Party Allows Solutions Equivalent To Those Described. 6. Demonstrating The Equivalence Of Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Is The Responsibility Of The Contractor And Should Be Documented By Him And Submitted With The Offer. 7. Pursuant To Art. 95 Of The Public Procurement Law, The Ordering Party Requires The Contractor Or Subcontractor To Employ, Under An Employment Contract, Persons Performing The Following Activities: A) Accepting Waste To The Point (Serving Persons Delivering Waste), B) Preparing Documentation Of Waste Accepted To The Point. This Requirement Does Not Apply To Persons Performing Equipment And Transport Services, Unless These Activities Constitute An Employment Relationship Under The Provisions Of The Labor Code (E.G. Self-Employment). To Confirm The Above, It Is Required That The Contractor Or Subcontractor, By The End Of Each Month Of Order Execution, Submit To The Ordering Party: A Written Declaration Of The Contractor Or Subcontractor On The Employment Under An Employment Contract Of Persons Performing Activities Related To The Execution Of The Order (I.E. Persons Accepting Waste To The Point, I.E. Serving Persons Delivering Waste, Persons Preparing Documentation Of Waste Accepted At The Point) Together With A List Of Persons Employed By The Contractor Or Subcontractor In The Execution Of The Order Under An Employment Contract - According To The Template Constituting Annex No. 3 To The Contract. 8.
