The Subject Of The Award Procedure Is The Procurement Of Electric Buses With Automated Or Autonomous Driving Functions And Their Testing, Including The Operating, Support And Other Services Required For This. Vehicle Procurement And Vehicle Testing Form A Legally And Economically Related Overall Service. Safe And Approval-Compliant Testing Requires Close Interaction Between The Vehicle Technology, The Automated Or Autonomous Driving Function And The Owner, Approval, Operating And Support Tasks To Be Carried Out As Part Of The Testing Operation. The Client Therefore Intends To Outsource These Services To One Contractor. Within This Uniform Procurement Project, Vehicle Procurement Takes Place On The Basis Of A Framework Agreement. The Services Required For Testing The Vehicles Are Also Part Of The Uniform Procurement Project, But Are Regulated Outside The Framework Agreement For Vehicle Procurement In A Separate Agreement For The Intended And Necessary Contract Period. The Details Of The Technical And Functional Requirements For The Vehicles As Well As The Services To Be Provided In Connection With The Testing Are Specified In More Detail In The Tender Documents For The Tender Phase. The Client Initially Intends To Procure Two Automated Or Autonomous Electric Buses As Part Of The Project. These Two Vehicles Basically Represent The Minimum Purchase Quantity. The Procurement Is Financed Through Grants; The Funding Period Ends On December 31, 2027. The Obligation To Make A Minimum Purchase Is Therefore Subject To The Condition That The Funding Provided For This Can Be Accessed Within The Funding Period. If The Funding Can No Longer Be Used Due To The End Of The Funding Period Or For Other Funding Reasons For Which The Client Is Not Responsible, The Obligation To Make A Minimum Purchase No Longer Applies. To The Extent That Vehicles That Have Already Been Approved For Autonomous Operation Are Not Available With An Operating License In Accordance With Section 1E Paragraph 4 Of The Stvg Or A Type Approval In Accordance With Implementing Regulation (Eu) 2022/1426, The Vehicles Should Currently Be Operated On The Basis Of A Test Permit In Accordance With Section 1I Of The Stvg In Conjunction With. V. M. § 16 Afgbv Can Be Used. The Vehicles Must Be Suitable For The Intended Test Operation And Be Eligible For Approval. The Framework Agreement Is Intended To Provide The Opportunity To React To Technical And Approval Developments During Its Term. In Particular, The Client Should Be Entitled, In Accordance With The Terms Of The Contract, To Exchange The Initially Purchased Vehicles For More Developed Vehicles That Have Been Approved For Possible Regular Operation And, If Necessary, To Call Up An Additional Vehicle.
