Cleaning Services – Maintaining The Cleanliness Of Rolling Stock. 1. The Subject Of The Order Is The Provision Of Comprehensive Cleaning Services For Railway Vehicles Used By The Ordering Party, Which Include Diesel Multiple Units Of The Sa105, Sa108, Sa132, Sa134, Sa139, Sa136atr Series And Electric Multiple Units Of The 48Web, 48We, 48Wed, En76, En57akw And En57al Series, As Well As Bimodal Units. Traction Units Of The 36Weh Series, Including Superficial And Extended Superficial Cleaning. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 4 To The Swz (Contract Template). 2. Detailed Requirements For The Provision Of The Service Are Included In Annex No. 1 To The Template Agreement. 3. The Subject Of The Order Will Be Implemented On Each Calendar Day Of The Contracts Validity Based On The Cleaning Schedule - Annex No. 7 To The Contract. The Contractor Is Obliged To Provide Services Constituting Auxiliary Activities Also Based On The Information Received From The Ordering Party. 4. During The Execution Of The Order, The Ordering Party Provides For The Possibility Of Exercising The Option Right Referred To In Art. 441 Of The Public Procurement Law In The Scope Of: 1) Quantity Options, 2) Schedule Options, 3) Additional Services Options. The Option Right Is An Entitlement Of The Ordering Party, Which He May, But Does Not Have To, Exercise As Part Of The Implementation Of The Contract. If The Ordering Party Does Not Exercise The Option Right, The Contractor Shall Not Be Entitled To Any Claims In This Respect. Important Provisions Of The Agreement Regarding The Conditions For Triggering The Option Right Are Specified In The Template Agreement, Which Constitutes Annex No. 4 To The Swz. 5. The Ordering Party, Pursuant To Art. 95 Section 1 Of The Public Procurement Law Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing Activities Related To The Execution Of The Contract, Consisting In Cleaning Railway Vehicles, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2026, Item 1245, As Amended). 6. Provisions Regarding The Method Of Verifying The Employment Of These Persons On The Basis Of The Employment Relationship And The Employers Rights To Control The Contractors Compliance With The Requirements Related To The Employment Of These Persons And The Sanctions For Failure To Meet These Requirements Are Included In The Template Agreement Constituting Annex No. 4 To The Swz. 7. The Provisions Of Sections 5 And 6 Do Not Apply To The Personal Performance Of The Order By A Natural Person, Including An Entrepreneur Running An Individual Business. 8. Deadline For Order Completion: From The Date Of Signing The Agreement, But Not Earlier Than From December 13, 2026 To December 11, 2027.
