Heating Oil – Delivery Of Heating Oil I. 1. The Subject Of The Order Is: Delivery Of Fuel Oil For Heating Purposes To The Registered Office Of The Ordering Party, 32. Blt Łask. 2. The Planned Place, Delivery Dates And Quantities Of The Ordered Heating Oil Are Included In The Order Description - Delivery Plan Constituting Annex No. 5 To The Swz. The Ordering Party Reserves The Right To Postpone Individual Batches Of Deliveries In The Following Months. 3. The Minimum Size Of A Single Delivery Is 15 M3 Of Heating Oil. 4. The Supplied Oil Must Meet The Quality Requirements Specified In The Pn-C-96024:2020-12 Standard (Or Equivalent) And Have The Following Parameters: 4.1. Calorific Value: Min. 42,600 Kj/Kg; 4.2. Ignition Temperature: Min. 56°C; 4.3. Density At 15°C: Max. 860 Kg/M3; 4.4. Sulfur Content % (M/M): Max. 0.2%; 4.5. Solidification Point: Not Higher Than Minus 20°C; 5. The Estimated Quantity Of Oil That The Ordering Party Plans To Order Under The Concluded Contract Is 535.00 M3 (Scope Of The Basic Order). The Quantity And Delivery Dates Are Indicative, And The Actual Quantity Of Heating Oil Ordered Is Limited By The Gross Amount (The Amount That The Ordering Party Intends To Allocate To Finance The Order) And Will Result From The Ordering Partys Current Needs And Its Ability To Store The Subject Of The Order. 6. The Ordering Party, In Accordance With Art. 441 Of The Public Procurement Act Provides For The Possibility Of Applying The Option Right In The Proceedings In Question Up To 150% Of The Value Of The Basic Order (I.E. The Amount That The Ordering Party Intends To Allocate To Finance The Basic Order). 7. If, During The Execution Of The Order, It Turns Out That The Ordering Party Has Financial Resources And The Need To Order A Larger Quantity Of Heating Oil Than Expected In The Unconditional Scope Of The Order, The Ordering Party Reserves The Right To Exercise The Option And Order Additional Oil Under The Concluded Contract. 8. If An Additional Quantity Of The Subject Of The Contract Is Ordered, Settlement Will Be Based On The Offer Of The Selected Contractor And The Concluded Contract, Calculated In The Same Way As In The Basic Order. 9. The Option Right May Only Be Used If The Basic Order Is Completed In 100%, I.E. The Amount Allocated For The Implementation Of The Basic Order Is Used. 10. The Ordering Party Reserves That The Part Of The Order Defined As An Option Right Is An Entitlement And Not An Obligation Of The Ordering Party. The Option May Or May Not Be Implemented In Whole Or In Part Depending On The Ordering Partys Needs And As A Result Of Its Instructions In This Regard. Failure To Complete The Order In This Respect May Not Give Rise To Any Claims On The Part Of The Contractor Against The Ordering Party. 11. The Contractor Agrees To Subject His Employees, Associates And Means Of Transport To The Rigors Of Security Procedures In Force In Military Unit 1158 During The Execution Of The Order In Accordance With The Requirements Of The Act Of August 22, 1997 On The Protection Of Persons And Property (Consolidated Text: Journal Of Laws Of 2025).
