1. The Subject Of The Order Is The Performance Of Construction Works For The Thermal Modernization Of The Primary School No. 227 87 At Ul. Malowniczej 31 In Warsaw Due To The Limited Number Of Characters, Continued Changes To The Ppu: 3) The Parties Allow For Changes To The Agreement In Terms Of Materials, Technical Parameters, Technology Of Construction Works, Method And Scope Of Execution Of The Subject Of The Agreement, In Relation To The Above-Mentioned. Parameters Specified In The Documents Referred To In § 1 Section 2 Of The Agreement, Caused By One Of The Following Circumstances) Unavailability On The Market Of Materials Or Devices Indicated In The Documents Specified In § 1 Section 2 Of The Agreement, Caused By The Cessation Of Production Or Withdrawal Of These Materials Or Devices From The Market, B) The Appearance On The Market Of New Materials Or Devices Of A Newer Generation Allowing For Savings In The Operating Costs Of The Completed Subject Of The Agreement, C) The Need To Implement The Subject Of The Agreement Using Other Technical And Technological Solutions Than Those Indicated In The Documents Specified In § 1 Section 2 Of The Agreement In A Situation Where The Application Of The Solutions Provided Could Result In Non-Performance Or Defective Performance Of The Subject Of The Agreement, D) The Need To Implement The Subject Of The Agreement Using Other Technical Or Material Solutions Due To Changes In Regulations, E) The Occurrence Of Geological, Geotechnical Or Hydrological Conditions That Differ Significantly From Those Adopted In The Design Documentation, The Occurrence Of Unexploded Ordnance Or Unexploded Shells, Which May Result In Non-Performance Or Improper Performance Of The Subject In The Light Of The Existing Assumptions. Agreements, F) Occurrence Of Field Conditions That Differ Significantly From Those Adopted In The Design Documentation, In Particular Encountering Uninvented Or Incorrectly Inventoried Networks, Installations Or Other Construction Facilities, 3.The Above Changes May Be Made Before The Expiry Of The Deadline For The Execution Of The Subject Of The Agreement, Specified In § 2 Of The Agreement, Upon A Written Request Submitted Within 7 Days From The Date Of Occurrence Or Receipt Of Information About The Circumstances. The Request Should Include Detailed Justification, Depending On The Event Or Circumstances Constituting The Basis For The Request For Change.4.The Basis For Preparing An Annex To The Agreement In The Scope Of § 14 Of The Agreement Will Be A Necessity Protocol Signed By An Authorized Representative Of The Contractor And Accepted By The Ordering Party.5.The Ordering Party Allows For Changes In The Remuneration In The Event Of Replacement, Additional Or Abandoned Works. 1) The Basis For Determining The Remuneration For The Replacement, Abandoned Or Additional Scope Of Works Will Be The Necessity Protocol Signed By The Authorized Representative Of The Contractor And Accepted By The Ordering Part
