The Subject Of The Order Is The Supply Of Medicines, Feeding Kits, Contrast Agents, Fluids Divided Into Packages Package No. I Medicines / Macrogol / Common Public Procurement Vocabulary (Cpv): - Package No. I: 33690000-3 A Detailed Description Of The Subject Of The Order Is Included In Annex No. 1 To The Swz. The Delivery Will Be At The Risk Of The Contractor. It Is The Responsibility Of The Person Submitting The Offer To Read The Swz And Annexes, Including The Prepared Draft Contract, And Obtain All Information Necessary For The Proper Preparation Of The Offer. The Ordering Party Does Not Allow The Submission Of Variant Offers. The Ordering Party Allows The Submission Of Partial Offers, But It Is Not Possible To Submit Partial Offers Within A Given Package. Part Of The Order Constitutes An Individual Package As A Whole. Otherwise, The Offer For A Given Package Will Be Rejected. The Ordering Party Allows The Submission Of Equivalent Offers. All Proper Names Of Materials Used In The Tender Documentation Are Provided As Examples And Specify Only The Minimum Expected Quality Parameters And The Required Standard. If Trademarks, Patents Or The Origin Of Materials Are Indicated In The Description Of The Subject Of The Order, It Is Assumed That Such Indications Are Accompanied By The Words Or Equivalent And Should Be Treated As Proposals. The Ordering Party Allows The Use Of Equivalent Materials To The Extent And In Such A Way That The Materials Used Have Parameters No Worse Than Those Designed, Fulfill The Function They Are Intended To Serve, And Do Not Change The Type And Scope Of Supplies. Wherever The Subject Of The Contract Includes A Specific Name, Approval, Technical Specification And Technical Reference Systems Established By European Standardization Bodies, If Trademarks, Patents And The Origin Of The Devices Are Indicated In The Description Of The Subject Of The Contract, They Should Be Treated As Auxiliary. It Is Allowed To Submit Solutions Equivalent To Those Described By The Ordering Party, In Accordance With The Principles Set Out In Art. 99 Section 5 Of The Public Procurement Law. When Describing An Item Equivalent To That Described In The Swz, The Contractor Is Obliged To Maintain Equivalence In Terms Of Quality, Utility, Functional And Aesthetic Parameters, Which Must Be At A Level Not Lower Than Those Indicated By The Ordering Party. In Such A Case, The Contractor Is Obliged To Present Its Detailed Specification Together With The Offer, Which Should Clearly Show The Ordering Party That The Offered Product Has No Worse Quality, Functional, Utility And Aesthetic Parameters Than Those Specified By The Ordering Party. Failure To Submit/Confirm Equivalence Will Result In Rejection Of The Offer As Inconsistent With The Terms Of The Order.
