The Ordering Party Requires A Brand New Car That Meets The Applicable Requirements And Standards.3.2. The Offered Car Must Have Brand New Equipment, Free From Defects, Covered By The Vehicle Manufacturers Warranty, Meeting The Requirements Of The Act Of June 20, 1997, Road Traffic Law (Consolidated Text: Journal Of Laws Of 2024, Item 1251, As Amended), The Regulation Of December 31, 2002 On The Technical Conditions Of Vehicles And The Scope Of Their Necessary Equipment (Consolidated Text: Journal Of Laws 2024, Item 502, As Amended), Applicable Polish Standards.3.3. The Minimum Requirements For The Car Are Included (Annex No. 2 To The Swz) Which Describes The Required Technical And Operational Parameters Of The Subject Of The Order.3.4. The Offered Car Must Have A Vehicle Type Approval Certificate Issued In Accordance With Applicable Regulations, In Particular The Act Of April 14, 2023. On Approval Systems For Vehicles And Their Equipment (Journal Of Laws Of 2023, Item 919, As Amended) And The Provisions Of European Union Law Regarding Vehicle Approval. The Homologation Of The Offered Car Must Enable Its Registration In Poland. 4. The Ordering Partys Indication Of The Name And/Or Catalog Number Of A Given Product From The Manufacturers Catalog Serves To Precisely Define The Subject Of The Order And Establish Standards, And Does Not Indicate A Specific Product Of A Given Manufacturer. Equivalent Offers May Be Submitted Provided That The Subject Of The Offer Is Functionally Identical And As Close As Possible In Terms Of Structure, Materials From Which It Is Made, Dimensions, Etc. To The Sample Products, And The Contractor Submits In The Offer An Appropriate Document Which Clearly Shows That The Offered Subject Of The Order Has Technical, Operational And Utility Parameters Not Worse Than Those Of The Indicated Product. All Risks (Including The Costs Of Possible Expert Opinions) Related To Proving Equivalence Rest With The Contractor.5.
