Cargo Handling And Storage Services – Negotiation Process For Area E1 In The Jadeweserport Gvz. Area E1 Is To Be Allocated To One Or More Companies For Commercial Settlements By Concluding Leasehold Contracts (With An Obligation To Build And Commission The Company Buildings/Production Facilities And A Maximum Term (Including Options) Of Up To 50 Years) Or By Concluding Rental Contracts (Hereinafter Also Collectively Referred To As: Land Contracts). The Conclusion Of A Leasehold Contract Is Only Possible If The Respective Bidder Makes Significant Investments Of His Own In Buildings And Facilities On The Site. If The Requirements For Concluding A Leasehold Agreement Are Not Met, Concluding A Rental Agreement Can Be Considered. The Aim Is To Establish Companies That Deal With The Processing Of Incoming And Outgoing Sea Freight And/Or Their Storage And/Or Transport And/Or The Associated Port-Related Services. An Express Operating Obligation In This Sense Is Agreed (Port-Related Settlement). However, Priority Should Be Given To Companies That Deal With The Processing, Storage And/Or Transport Of Containers/Containerized Goods. The (Then) Contractual Partner Will Be Contractually Obliged To Make The Services It Offers Available To Customers In A Non-Discriminatory Manner (If Necessary For An Appropriate Fee). The (Then) Contractual Partner Establishes And Operates The Respective Settlement Project Under His Own Entrepreneurial Responsibility, Taking Into Account The Provisions Of Public Law. Within The Framework Of The Requirements Of The Property Contract And The Public Law Regulations, He Independently Determines The Structural Design, Operational Management And The Range Of Goods And Services Of The Company. The (Then) Contractual Partner Is Solely Financially Responsible For His Investments. On Area E1, The Respective Settler Must Build A Port-Related Settlement In Accordance With The Above Statements. The Settlement Must Therefore Meet The Following Minimum Requirements: A) Obligation To Permanently Operate Area E1 For The Processing Of Incoming And Outgoing Sea Freight And/Or Their Storage And/Or Transport And/Or The Associated Port-Related Services; B) Obligation To Construct The Necessary Structures And Facilities To Be Bindingly Determined In The Contract And C) Remuneration In The Amount Of: At Least Eur 7.00/M²/Year (Value Secured). It Is Clarified That The Above Minimum Requirements Are Also Bindingly Agreed Upon As Part Of The Property Contract As Obligations Of The Settler. Negotiations On The Minimum Requirements Will Not Be Possible.
