Stadium Construction Work – Concession – Design, Construction And Operation Of The Winter Stadium In The City Of Bruntál. The Subject Of The Public Contract – Concession Is The Creation Of The Appropriate Levels Of Project Documentation For The Purpose Of Building A Winter Stadium In The City Of Bruntál (Hereinafter Referred To As Zsb), Engineering Activities Related To The Construction Of Zsb, Construction Of Zsb And Subsequent Operation Of Zsb. In Addition To The Zsb Hall Itself, The Subject Of Design And Construction Is Also The Construction Of Outdoor Volleyball Courts And Parking Areas Around The Zsb Hall, Including Service Access Roads. However, The Subsequent Operation Concerns Only And Exclusively Zsb, Not Outdoor Volleyball Courts, Parking Areas And Access Roads. Parking Areas Will Be Publicly Accessible, Including Service Access Roads; Management And Operation Of The Outdoor Volleyball Courts Will Be Provided By The Contracting Authority At Its Own Expense. The Contracting Authority Has A Valid Permit To Implement The Construction Of The Winter Stadium (Building Permit) And The Relevant Project Documentation, Which Forms Appendix No. 12 Of This Procurement Documentation. The Supplier Is Entitled, But Not Obliged, To Use This Existing Permit For The Implementation Of The Subject Of The Public Contract; Its Use Is Therefore Only Optional And Is Entirely At The Suppliers Discretion. If The Contractor Decides To Use The Existing Permission, He Is Obliged At His Own Expense, Risk And Responsibility To Ensure Its Subsequent Change, I.E. Permission To Change The Plan Before Its Completion In Accordance With § 224 Of The Construction Act, So That The Permission Corresponds To The Project Documentation Prepared By Him And The Actual Execution Of The Construction, And This Before The Completion Of The Construction At The Latest. The Contracting Authority Does Not Provide A Guarantee For The Usability Of The Existing Permit For The Solution Proposed By The Supplier; Responsibility For Assessing Its Usability, For The Choice Of Procedure And For All The Consequences Associated With It Is Fully Borne By The Supplier. The Use Or Non-Use Of The Existing Permit Does Not Affect The Bid Price Or The Performance Time. Details Are Set Out In Annex No. 3 Of The Procurement Documentation. A More Detailed Specification Of The Performance Is Given In Particular In Annexes No. 3 And No. 11 (Or No. 12) Of The Procurement Documentation, Which Is An Integral Annex Thereof.
