The Subject Of The Order Is The Sale (Delivery) Of Electricity In The Exchange Model In Accordance With Applicable Regulations, In Particular The Provisions Of The Regulation Of The Minister Of Climate And Environment Of March 22, 2023 On Detailed Conditions For The Operation Of The Power System (Journal Of Laws Of 2025, Item 919) To The Ordering Partys Consumption Points. Energy Will Be Consumed For The Needs Of The Ordering Party, Which Is Not An Energy Company Within The Meaning Of The Energy Law Act Of April 10, 1997 (Consolidated Text: Journal Of Laws Of 2026, Item 43, As Amended). The Subject Of The Contract Is Specified In This Specification Of Terms Of Procurement (Swz) Together With The Draft Provisions Of The Public Procurement Contract (Appendix No. 5 To The Swz). The Contractor Will Be Obliged To Sell Electricity To The Ordering Party From January 1, 2027, But Not Earlier Than From The Date Of Effective Completion Of The Procedure For Changing The Electricity Supplier With The Distribution System Operator (Dso), If Such A Procedure Is Necessary. 4. Settlement Of The Supply (Sale) Of Electricity Will Be Based On The So-Called Stock Exchange Model (Stock Quotations On The Futures Market And The Day Ahead Market Of Tge Sa), In Accordance With The Assumptions Indicated In The Swz. The Ordering Party Has The Right To Purchase 100% Of The Volume Of Electricity Consumed During The Contract Implementation Period Based On The So-Called Stock Exchange Model, I.E. Based On Stock Quotations Of The Futures Market, Published On The Website Of Towarowa Giełda Energii S.A. (Tge), I.E.: Annual Band Contract (Base_Y) (Appropriate For A Given Sales Period) And The Exchange Quotations Of The Day Ahead Market (Dam), Published On The Tge Website. If The Ordering Party Does Not Make A Decision To Order Energy Within The Time Specified In Section. 5 Above The Base_Y And Base_Q Contracts Covering 100% Of The Volume Of Electricity Consumed In A Given Monthly Sales Period, The Remaining Part, For Which No Price Will Be Set, Will Be Settled Based On The Price Determined On The Basis Of Quotations On The Day Ahead Market (Dam) Of The Polish Power Exchange. For Each Month Of Sales, In Accordance With The Formula Specified In The Concluded Contract. The Ordering Party Is A Party To The Contract For The Provision Of Electricity Distribution Services With The Dso, Which Is Pge Dystrybucja S.A. Białystok Branch (Ul. Elektryczna 13, 15-950 Białystok). The Contractor Is Obliged To Notify The Dso To Implement The Electricity Sales Contract Concluded As A Result Of These Proceedings, As Well As To Represent The Ordering Party Before The Dso In Matters Related To The Concluded Contract (In Particular In Connection With The Procedure For Changing The Electricity Supplier - If Necessary). The Ordering Party Will Provide The Contractor With An Appropriate Power Of Attorney To Submit The Concluded Electricity Sales Agreement To The Dso On Behalf Of The Ordering Party And To Perform The Activities Necessary To Carry Out The Change Process.
