Part I Of The Order - Delivery Of 2 (Two) Ngfw Devices. The Description Of The Subject Of The Order Is Attached As Annex No. 3 To The Swz.1. If The Subject Of The Order Includes Or May Include An Ict Product, An Ict Service Or An Ict Process, The Contractor Is Obliged To Offer Only Such Ict Products, Ict Services And Ict Processes Which, On The Date Of Submission Of Offers: A) Are Not Indicated In The Recommendation Referred To In Art. 33 Section 4 Of The Act Of July 5, 2018 On The National Cybersecurity System (Consolidated Text: Journal Of Laws Of 2026, Item 20, As Amended), Hereinafter Referred To As The Ksc Act, Stating Their Negative Impact On The Fundamental Interest Of State Security; B) Do Not Include An Ict Product, The Type Of Which Was Specified In The Decision On Recognizing The Supplier As A High-Risk Supplier, Referred To In Art. 67B Section 15 Of The Ksc Act, Nor The Ict Service Or Ict Process Specified In This Decision.2. If The Contractor Offers Ict Devices, He Is Obliged To Clearly Identify In The Table Of The Offer Form - Each Ict Device Offered, In Particular By Indicating: A) The Name Of The Solution, Manufacturer Or Supplier, B) Type, Model, Version Or Other Marking Allowing Its Identification, C) Series Or Product Line, D) Proposed Software, Code Or License Name, Version Of The Operating System Or Firmware, E) Function Performed As Part Of The Execution Of The Order, Etc.,9.The Inability To Clearly Identify The Offered Ict Device Is The Responsibility Of The Contractor.3.If The Content Of The Offer, Documents Submitted With The Offer Or The Contractors Explanations Indicate That The Offer Includes Devices: A) Included In The Recommendation Referred To In Art. 33 Section 4 Of The Ksc Act, B) Indicated In The Decision To Recognize The Supplier As High Risk, Provided For In Art. 67B Section 15 And 16 Of The Ksc Act (However, It Is Sufficient To Indicate The Ict Product, Ict Service Or Ict Process In The Decision, But It Is Not Necessary To Recognize The Contractor Itself As A High-Risk Supplier), The Offer Will Be Subject To Rejection Pursuant To Art. 226 Section 1 Point 17 Or Point 19 Of The Public Procurement Law. Whenever The Content Of The Swz, Including The Description Of The Subject Of The Contract, Uses Trademarks, Patents Or Origins, Sources Or Specific Processes, As Well As Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, The Ordering Party Allows A Solution Equivalent To The One Described. A Product Equivalent To The Specified Subject Of The Order Is Understood As A Product With The Minimum Requirements Parameters Specified (Listed) And Specified In The Detailed Scope And Description Of The Subject Of The Order Included In Annex No. 1 To The Swz. The Ordering Party Allows The Submission Of Materials, Goods Or Equivalent Solutions, And All Goods Specified In The Documentation, From Specific Manufacturers, Specify The Minimum Quality Parameters And Functional Features That The
