Software Package And Information Systems – Purchase And Delivery Of Software As Part Of The Project Netforce-Network For Financial Crimes Against European Union Enforcement. The Subject Of The Order Is The Purchase And Delivery As Part Of The Netforce-Network For Financial Crimes Against European Union Enforcement Project Of The Xry Pro Ultimated Software Or Equivalent Software Meeting The Criteria/Functionality Specified In Annex No. 3 To The Swz. The Ordering Party Plans To Purchase 1 Piece Of This Software. The Program Functions Described In Annexes No. 3 To The Swz Constitute The Minimum Requirements Of The Ordering Party. The Ordering Party Requires That The Offered Ict Products, Ict Services And Processes The Ict Used To Complete The Order, Both As Main Elements And Components, Elements Of The Service Provision Environment Or Accompanying Solutions, Did Not Include: Ict Products, Ict Services Or Ict Processes Indicated In The Recommendation Referred To In Article 33(4) Of The Act Of July 5, 2018 On The National Cybersecurity System, Stating Their Negative Impact On The Fundamental Interest Of State Security, Or The Ict Product Whose Type Was Specified In The Decision On Recognizing The Supplier As A High-Risk Supplier, Referred To In Art. 67B Section 15 Of The Act Of July 5, 2018 On The National Cybersecurity System, Or To Change The Delivered Ict Services Or Ict Processes Specified In This Decision. Failure To Meet The Above Requirements Results In Rejection Of The Offer Pursuant To Article 226 Section 17 Or Point 19 Of The Public Procurement Law. The Offered Product Has Been Withdrawn From Sale Or Its Production Has Been Discontinued, It Is No Longer Available On The Polish Market (Confirmed By The Manufacturer Or Sales Representative On The Polish Market). The Ordering Party Allows For The Delivery Of Another Product Provided That The Requirements Specified In Section Iv Of The Swz Are Met, And If Its Functionality Is Not Inferior To That Of The Offered Product, It Meets The Requirements Specified In The Order Documents At Least To An Equivalent Extent, And The Unit Price Is Not Higher Than That Offered In The Offer Form In The Case Referred To Above, The Contractor Must Obtain The Ordering Partys Consent To Change The Offered Product. If The Contractor Does Not Justify The Need For A Change, The Ordering Party Shall Have The Right Not To Consent To The Change Of The Offered Product. In Such A Case, The Contractor Will Be Obliged To Deliver The Offered Product In Accordance With The Content Of The Offer In Writing Ul. J. Lompy 19, Block E. The Ordering Party Requires That The Product Is Brand New, Grade I, Not For Exhibition, Free From Technical And Legal Defects, Approved For Trading, And Meets The Quality And Use Standards Indicated By The Ordering Party In Annex No. 3.1 To The Swz.
