Description Of The Subject Of The Order.1.The Subject Of The Procedure And Order Is To Select A Contractor For Construction Works And Greenery Plantings Along With Maintenance Related To The Construction Of The Park At The Fort In Bronowice, Stage Iv, For The Municipal Greenery Board In Krakow. 1.1 Pursuant To Art. 310 Of The Public Procurement Act, The Ordering Party Provides For The Possibility Of Invalidating The Procedure In Question If The Public Funds That The Ordering Party Intended To Use To Finance All Or Part Of The Order Were Not Granted To It. 1.2 The Subject Of The Proceedings And Order Is An Investment Related To The Implementation Of The Task Titled: Zzm/O1.8/26 Park At The Fort In Bronowice. 1.3 The Investment Area Is Located On Plot No. 167/57, District K-2, Unit Krowodrza Register.1.4 The Scope Of The Order Includes The Execution Of Construction Works As Well As The Planting Of Greenery And Its Maintenance.1.5 The Order Should Include The Basic Scope And Possibly The Scopes Covered By The Rights Of Options 1 And 2, In Whole Or In Part, To Which The Ordering Party Is Entitled (These Scopes Are Only Indicative And Their Exact Scope And Method Of Development Should Be Read From The Design Documentation), With: 1.5.1 Basic Scope: Preparatory, Demolition And Disposal Related To The Building, Construction Works Related To The Foundations, Roof And Steel Structure, Works Related To Electrical, Sanitary And Ventilation Installations; 1.5.2 Scope Of Option No. 1: Modernization Of The Ramp Along With The Construction Of Small Architecture Facilities, Sports Equipment, Construction Of Surfaces, Lighting And Drinking Fountains, Fencing For The Dog Run; 1.5.3 Scope Of Option No. 2: Implementation Of Greenery Works Along With The Care Of Plantings. 1.6 The Ordering Party Reserves The Right To Exercise The Option Right In Whole Or In Part Regarding The Scope Of Options No. 1, 2 In Whole Or In Part, Specified, Among Others, In Art. 441 Of The Public Procurement Law, I.E. Increasing The Scope Of The Subject Of The Contract. Therefore, The Ordering Party May, But Does Not Have To, Commission The Contractor To Perform An Order Covered By The Option Right In Whole Or In Part. The Contractor Is Not Entitled To Any Claims Due To The Ordering Partys Failure To Exercise The Option Right, In Whole Or In Part. The Ordering Party Guarantees The Execution Of The Basic Order. The Contractor Is Entitled To Remuneration For The Scope Of The Contract Actually Completed. The Ordering Party Makes The Exercise Of The Option Right Dependent On The Financial Capacity Allowing For Their Implementation.
