The Subject Of The Order Is The Collection And Management (Recovery And Disposal) Of Mixed And Selectively Collected Municipal Waste From Property Owners Living In The Niedźwiada Commune - Regardless Of Their Quantity (Except For Waste Containing Asbestos) And The Collection And Management Of Waste Collected At The Selective Municipal Waste Collection Point (Pszok) In Accordance With The Provisions Of The Act Of September 13 1996 On Maintaining Cleanliness And Order In Municipalities, In Particular: 1) Equipping Single-Family Properties Reported By The Ordering Party With The Necessary Containers For Collecting Mixed Waste In Accordance With The Provisions Contained In Point 6 Of Annex No. 1 To The Swz And Collecting The Containers After The End Of The Contract. 2) Equipping The Multi-Family Properties Reported By The Ordering Party With The Necessary Containers For Collecting Mixed Waste And Containers For Selective Collection In Accordance With The Provisions Contained In Point 6 Of Annex No. 1 To The Swz And Collecting The Containers After The End Of The Contract. 4.2. The Estimated Amount Of Basic Waste Is 1,133.29 Mg, Including 947.86 Mg From Residents And 185.43 Mg From Pszok. The Maximum Quantity Covered By The Option Right Is An Additional 339.99 Mg, Which Gives A Maximum Of 1,473.28 Mg. The Quantities Of Individual Fractions Are Specified In Annex 1 To The Swz And The Price Form. 3. The Ordering Party Reserves The Right To Exercise The Option Right (In Whole Or In Part) If It Is In The Ordering Partys Interest And Results From Its Current Needs (Increased Amount Of Waste Collected By Residents) - After Completing The Basic Scope Of The Order. The Ordering Party Will Provide Written Information To The Contractor About The Need To Exercise The Option Right As Part Of The Implementation Of The Contract. The Option Right Is A Unilateral Right Of The Ordering Party, Which It May, But Is Not Obliged To Use, As Part Of The Implementation Of The Subject Of The Order. If The Ordering Party Fails To Exercise The Option Right, The Contractor Shall Not Be Entitled To Any Claims In This Respect. If The Ordering Party Exercises The Option Right, The Contractors Contractual Obligation Is To Perform The Service Within The Scope Of The Exercised Option Right. The Ordering Party Has The Right To Exercise The Option Right Multiple Times After Completing The Basic Scope Of The Order - But Until The Maximum Scope Of The Option Right Is Exhausted. Collection Of Waste In Excess Of The Option Law Requires An Amendment To The Contract. Activating The Option Will Not Require Changing The Contract. The Ordering Party Will Inform The Contractor In Writing About The Activation Of The Option In The Form Of A Declaration Of Will. 4. The Scope And Method Of Implementing The Subject Of The Order Are Specified In (Appendix No. 1 To The Swz) - Detailed Description Of The Subject Of The Order (Opz) And The Draft Agreement Constituting (Appendix No. 2 To The Swz).
