Prior Information Notice For Public Road Transport Services - Awarding Of Passenger Transport Services In Regular Service With Motor Vehicles In The Districts Of Böblingen, Calw And Tübingen; Line Bundle Bb11 “Oberes Gäu” In The Open Process.. The Districts, As Responsible Authorities And Responsible Authorities, Intend To Award A Public Service Contract (Ödla) For Public Passenger Transport Services With Motor Vehicles In Accordance With Section 2 (1) Pbefg In Accordance With Section 6 Paragraph 1, 3 Öpnvg-Bw In Conjunction With Section 8A Pbefg And Art. The Award Is Made Through The Open Procedure. The Subject Of The Intended Ödla Is The Public Passenger Transport Services On Lines 774, 774A, 777, 778, 790, N70 And X77. The Transport Services Included At The Start Of Operations (See Section 5.1.3.) Are Described In The Referenced Documents (See Section 2.1.4.). In Total, According To The Current Planning Status, The Transport Services To Be Awarded Amount To Approximately 1,470,000 Commercial Vehicle Kilometers Per Year. This Is A Regular Service In Accordance With Section 42 Pbefg, Which Is Awarded As A Total Service. According To Section 5.1.3, The Contract Will Have A Term Of 137 Months. The Contract Can Be Extended To A Total Contract Term Of A Maximum Of 15 Years, I.E. By 43 Months, If This Becomes Necessary For Amortization Due To Significant Investments In Rolling Stock. The Public Service Contract Will Contain Clear, Precise And Unambiguous Rules On The Conditions For Extension. In The Case Of Transport Carried Out Independently, The License Holder Must Provide Evidence To The Licensing Authority Of Investments In The Rolling Stock That Cannot Be Amortized In The Current Term. The Districts Reserve The Right To Adapt The Transport Services Within The Framework Of The Award To Changing Transport Needs, Financial Conditions Or An Update Of The Local Transport Plan During The Term Of The Public Service Contract. The Modalities For Adapting The Transport Offer Are Determined In The Public Service Contract. Even In The Case Of Self-Financed Transport, It Is Possible To React To Changing Transport Needs Or Financial Conditions Or To Update The Local Transport Plan In Coordination Between The Responsible Authority And The Licensing Authority, As Long As This Does Not Significantly Change The Transport Performance. The Operator Is Granted An Exclusive Right Within The Meaning Of Article 2 Lit. F Of Regulation (Ec) No. 1370/2007. According To Section 8A Paragraph 8 Pbefg, The Exclusive Right Only Relates To The Protection Of Transport Services That Are The Subject Of The Public Service Contract And That Have A More Than Insignificant Impact On The Passenger Potential Of These Services. The Responsible Authority Determines The Spatial And Temporal Scope As Well As The Type Of Passenger Transport Services That Are To Be Provided To The Exclusion Of Other Operators.
