Credit Granting Services – Taking Out A Long-Term Loan In The Amount Of Pln 11,000,000.00, Intended To Cover The Planned Budget Deficit Of The Mszczonów Commune In 2026. 1. The Subject Of The Order Is The Provision Of A Service Consisting In Granting A Long-Term Loan In The Amount Of Pln 11,000,000.00 (Eleven Million Zlotys) To Cover The Planned Budget Deficit Of The Mszczonów Commune In 2026 In The Amount Of Pln 11,000,000.00. 2. Detailed Terms Of The Order Along With The Loan Repayment Schedule Were Specified In The Swz And In The Essential Provisions Of The Agreement, Constituting Annex No. 6 To The Swz. 3. The Ordering Party Reserves The Right Not To Collect The Full Loan Amount. The Minimum Loan Value That The Ordering Party Will Use Is Pln 4,000,000.00 (Four Million Zlotys). The Contractor Will Not Charge Any Fee Or Commission On The Unused Loan Amount. The Parties Will Agree On A New Loan Repayment Schedule And The Arrangements Made Will Be Recorded In The Form Of An Annex To The Contract. 4. The Subject Of The Order Was Not Divided Into Parts. The Ordering Party Does Not Allow The Submission Of Partial Offers. The Ordering Party Did Not Divide The Order Into Parts Because The Subject Of The Order Is To Grant One Loan, Which Constitutes A Coherent Whole. Splitting The Loan Between Several Contractors Is Not Justified And Could Cause Additional Difficulties In Servicing It, In Particular The Need To Conclude And Maintain Several Contracts, Establish Different Loan Terms And Make Settlements With Several Banks. Granting A Loan By One Contractor Will Allow For Simpler And More Efficient Servicing Of The Obligation And Will Limit Additional Administrative Obligations On The Part Of The Ordering Party. Dividing The Order Into Parts Could Cause Problems With Obtaining A Loan On The Most Favorable Terms. The Larger The Loan Amount, The Proportionally Lower The Commission And Margin Costs. Not Dividing The Order Will Not Violate The Principle Of Fair Competition. According To Recital 78 Of Directive 2014/24/Eu, The Contracting Authority Should Be Obliged To Consider The Advisability Of Dividing Contracts Into Lots, While Retaining The Freedom To Make Autonomous Decisions On Any Basis It Considers Appropriate, Without Being Subject To Administrative Or Judicial Supervision. Due To The Above, The Ordering Party Decided That Dividing The Contract Into Parts Is Not Advisable. 5.
