The Subject Of The Order Is The Collection, Transport And Disposal Of Medical Waste Generated And Transferred By Ostrzeszowskie Centrum Zdrowia Sp. Z O. O. In Ostrzeszów. The Estimated Amount Of Medical Waste To Be Collected, Transported And Disposed Of Within A Period Of 24 Months Is Indicated In The Price Form Constituting Annex No. 1A To The Swz. The Amounts Of Waste Given In The Price Form Are Estimates And May Change Depending On The Actual Needs Of The Ordering Party. The Ordering Party Guarantees The Implementation Of The Basic Order To The Minimum Extent Of 60% Of The Gross Value Of The Basic Order Resulting From The Offer. Contractor. Failure To Complete The Order To The Full Extent Of The Estimated Amount Of Kilograms Of Waste, While Maintaining The Minimum Scope Of Implementation Of The Basic Order Indicated Above, Cannot Constitute The Basis For The Contractor To Pursue Claims Against The Ordering Party. Option Right. The Ordering Party, In Accordance With Art. 441 Of The Public Procurement Act, Provides For The Possibility Of Exercising The Option Right To Increase The Scope Of Services Covered By The Basic Order, I.E. Collection, Transport And Disposal Of Medical Waste, Up To A Maximum Of 30% Of The Value Of The Basic Order. The Option Right May Be Used In The Event Of An Increase In The Actual Amount Of Medical Waste Generated By The Ordering Party During The Order Execution Period In Relation To The Quantities Accepted For The Basic Order. Services Provided Under The Option Right Will Be Performed On The Same Conditions As The Basic Order And Will Be Settled According To Prices Net Unit Costs Indicated By The Contractor In The Price Form - Annex No. 1A To The Swz, Taking Into Account Changes In Remuneration Allowed In Accordance With The Provisions Of The Contract. The Ordering Party May Exercise The Option Right Once Or Multiple Times, In Parts, During The Term Of The Contract, But The Total Value Of Services Provided Under The Option Right May Not Exceed 30% Of The Value Of The Basic Order. The Exercise Of The Option Right Will Take Place By The Ordering Party Submitting To The Contractor A Declaration On Activation Of The Option Right And Defining The Scope Of Services. Covered By The Option. Exercising The Option Right Is A Right, Not An Obligation, Of The Ordering Party. The Contractor Is Not Entitled To A Claim For The Ordering Party To Use The Option Right In Whole Or In Part. Exercising The Option Right Does Not Extend The Order Execution Period. Waste Weighing Will Be Carried Out Using A Verified Device Belonging To The Contractor, At The Time Of Waste Collection At The Ordering Partys Premises, In The Presence Of The Ordering Partys Representative. The Ordering Party Reserves The Right To Control The Amount Of Waste Transferred Using Its Own Certified Device. The Contractor Must Have A Medical Waste Disposal Plant With A Capacity Ensuring The Neutralization Of Waste Originating From The Ordering Party, In The Quantities
