The Subject Of The Order Is The Collection And Management Of Municipal Waste From Owners Of Residential Properties And From The Selective Municipal Waste Collection Point (Pszok) In The Tomaszów Lubelski Commune.4.1. The Subject Of The Order Will Be Implemented In A Way That Ensures Achievement Of Appropriate Levels Of Recycling, Preparation For Reuse And Recovery Using Other Methods And Limiting The Mass Of Biodegradable Municipal Waste Sent To Landfill, In Accordance With The Provisions Of The Act Of September 13, 1996 On Maintaining Cleanliness And Order In Municipalities (Consolidated Text: Journal Of Laws Of 2025, Item 733) And Implementing Acts, As Well As The Provisions Of The Management Plan Valid During The Period Of Execution Of The Order. The Subject Of The Order Should Be Performed In Accordance With Environmental Protection Law And Sanitary Regulations, Including The Regulation Of The Minister Of The Environment Of January 11, 2013 On Detailed Requirements For The Collection Of Municipal Waste From Property Owners (Journal Of Laws Of 2013, Item 122), The Regulation Of The Minister Of Climate And Environment Of May 10, 2021 On The Method Of Selective Collection Of Selected Waste Fractions (Journal Of Laws Of 2021, Item 906).4.3. The Approximate Amount Of Municipal Waste That The Ordering Party Expects To Be Collected From Owners Of Residential Properties And From The Selective Municipal Waste Collection Point During The Order Implementation Period Is Approximately 1,931.42 Mg (Basic Scope Of The Order), And The Amount Covered By The Option Right: An Additional 891.65 Mg.4.4. The Ordering Party Reserves The Right To Exercise The Option Right (In Whole Or In Part) If It Is In The Ordering Partys Interest And Results From Its Current Needs (Increased Amount Of Waste Collected By Residents) - After Completing The Basic Scope Of The Order. The Ordering Party Will Provide Written Information To The Contractor About The Need To Exercise The Option Right As Part Of The Implementation Of The Contract. The Option Right Is A Unilateral Right Of The Ordering Party, Which It May, But Is Not Obliged To Use, As Part Of The Implementation Of The Subject Of The Order. If The Ordering Party Fails To Exercise The Option Right, The Contractor Shall Not Be Entitled To Any Claims In This Respect. If The Ordering Party Exercises The Option Right, The Contractors Contractual Obligation Is To Perform The Service Within The Scope Of The Exercised Option Right. The Ordering Party Has The Right To Exercise The Option Right Multiple Times After Completing The Basic Scope Of The Order - But Until The Maximum Scope Of The Option Right Is Exhausted. Collection Of Waste In Excess Of The Option Law Requires An Amendment To The Contract. Activating The Option Will Not Require Changing The Contract. The Ordering Party Will Inform The Contractor In Writing About The Activation Of The Option In The Form Of A Declaration Of Will.
