Medical Equipments – Purchase Of A Computed Tomography Scanner And Adaptation Of Rooms For The Needs Of Szpital Lipno Sp. Z O. O.. The Subject Of The Order Is The Delivery Of A Computed Tomography Scanner Along With The Adaptation Of The Rooms - A Detailed Description Of The Subject Of The Order Is Included In Annex No. 7 To The Swz.  The Offered Subject Of The Order Must Be Brand New, Free From Physical And Legal Defects, Complete And After Assembly/Installation/Setting, Ready For Use In Accordance With Its Intended Purpose, Without The Need For The Ordering Party To Incur Additional Financial, Organizational And Technical Outlays. The Offered Subject Of The Order Must Be Approved For Marketing And Use In Health Care Units In The Territory Of The Republic Of Poland In Accordance With Polish And Eu Law. Must Have Valid Polish Or Eu Certificates/Certificates Of Approval For Use In Medical Entities - If Applicable. The Contractor Declares That The Equipment Is A Medical Device Within The Meaning Of The Act Of April 7, 2022 (Journal Of Laws Of 2024, Item 1620, As Amended) On Medical Devices And Meets All The Requirements Specified In This Act And The Regulations Issued On Its Basis.  The Contractor Declares That It Will Implement The Subject Of The Agreement In Accordance With Applicable Law, In Particular The Act On Medical Activities And The Atomic Law, Including Installation, Servicing, Calibration And Inspections, Which Will Be Performed By Persons Authorized In Accordance With The Act On Medical Devices.  The Subject Of The Contract Will Be Performed In Accordance With Polish Standards And Legal Provisions. The Work Must Be Performed In Accordance With The Requirements And Applicable Regulations, In Particular The Requirements Of The Construction Law, Regulations On Health And Safety In The Performance Of Construction Works And In Accordance With The Principles Of Technical Knowledge, Documentation, Due Diligence In Their Execution, Good Quality And Proper Work Organization.  The Contractor Declares And Guarantees That He Has Appropriate Knowledge, Experience, Qualifications, Specialization, Tools And Software Necessary For The Proper Performance Of The Subject Of The Order And That There Are No Legal Or Factual Obstacles Preventing Or Hindering Him From Performing These Duties, As Well As That He Has All Rights, Including Licenses, To The Software With Which He Will Perform It.  If The Description Of The Subject Of The Contract Refers To Any Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Pzp - It Should Be Assumed That Such References Are Accompanied By The Words Or Equivalent, Which Means That The Contracting Authority Allows Solutions Equivalent To Those Described And Allows The Submission Of Equivalent Offers In This Respect (In Accordance With Article 101(4) Pzp).  Pursuant To Art. 101 Section 5 Of The Public Procurement Law, A Contractor Who Refers To Solutions Equivalent To Those Described In These Documents Is Obliged To Prove That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Contract To An Equivalent Extent. The Equipment May Be Replaced By An Equivalent One That Is No Worse Than That Indicated
