The Transport Of Aggregate From The Contractors Warehouse Is Ensured By The Ordering Party At Its Own Expense And At Its Own Expense. If It Is Not Possible To Assess The Amount Of Received Aggregate By Weight For Settlement Purposes And Determine The Weight Of The Delivered Aggregate In Tons, A Volume-To-Mass Conversion Rate Is Used Resulting From The Grain Density Parameters: 1M3 Of Aggregate = 1.75 Tons (1750 Kg). Pursuant To Art. 441 Of The Public Procurement Law The Ordering Party Envisages The Application Of The Option Right In Relation To The Subject Of The Order, I.E. The Ordering Party Will Determine The Minimum Quantity Of Aggregate, The Receipt Of Which The Ordering Party Guarantees, The So-Called Basic Order And Specifying The Quantity Of Aggregate And Prices At Which The Ordering Party Will Be Entitled (But Not Obliged) To Accept, Defined As Covered By The Option Right And The Contractor Will Be Obliged To Deliver, However, The Order Will Be Fulfilled Only If The Contractor Is Provided With Appropriate Information About The Exercise Of The Option Right. The Order Is Divided Into: - Basic Order (Guaranteed): 15,000 Tons Of Aggregate - Order Covered By Option Rights: Up To 15,000 Tons Of Aggregate. The Ordering Party Guarantees The Receipt Of The Quantity Of Aggregate Specified In The Basic Order. An Order Within The Scope Of The Option Right Is A Unilateral Right Of The Ordering Party. Failure To Execute The Order Within The Scope Of The Option Right Does Not Constitute Grounds For The Contractor To Pursue Any Compensation Or Financial Claims Against The Ordering Party. The Condition For Exercising The Option Right Is That The Ordering Party Provides The Contractor With A Written Declaration Of Will To Exercise The Option Right (In Whole Or In Part).
