4.1.The Subject Of The Order Is The Supply Of Reagents And Laboratory Materials.4.2.The Subject Of The Contract Is Divided Into Two (2) Parts, Including:4.2.1.Part I – Reagents,4.2.2.Part Ii – Laboratory Materials.4.3.The Detailed Scope Of The Subject Of The Order Is Included In The Product And Price Specification, Constituting Annex No. 3 To The Swz (Hereinafter Referred To As The Specification). 4.4.The Subject Of The Order Must Be New And Originally Packed.4.5.The Subject Of The Order Should Have Safety Data Sheets/Quality Certificates/Calibration Certificates Or Certificates.4.6.The Documents Referred To Above Will Be Obliged To Be Provided By The Contractor To Whom The Order Is Awarded To The Ordering Party Along With The Delivery Of The Subject Of The Order.4.7.The Shelf Life Of Reagents/Warranty For Laboratory Materials Should Be At Least 12 Months From The Date Of Delivery To The Ordering Party.4.8.Acting Pursuant To Art. 100 Paragraph 1 Of The Public Procurement Act, The Ordering Party Informs That In The Scope Of Part I - Reagents, The Requirements Regarding Accessibility For People With Disabilities And Design For All Users Are Not Taken Into Account. Departure From The Above-Mentioned Requirements Is Fully Justified By The Specific Nature Of The Subject Of The Contract. Chemical Reagents Are Substances With A Strictly Defined Physicochemical Composition, Whose Properties Are Determined Exclusively By Scientific Standards And Research Procedures. These Substances Do Not Have Functional Properties That Could Be Modified For Universal Design. All Laboratory Procedures Using These Materials Are Carried Out In Controlled Laboratory Conditions, In Accordance With Occupational Health And Safety Regulations Regarding Work With Hazardous/Chemical Substances, Using Dedicated Protective And Laboratory Equipment, Which Excludes The Possibility And Validity Of Common Universal Design Of The Substance Itself.4.9.Pursuant To Art. 100 Paragraph 1 Of The Public Procurement Law, The Ordering Party Requires That The Offered Laboratory Materials For Part Ii - Laboratory Materials Meet The Criteria Of Universal Design And Are Adapted To The Needs Of All Users, Including People With Disabilities. The Minimum Functional And Ergonomic Requirements Are Described In Annex 3 To The Swz - Product And Price Specification.4.10.To Confirm That The Products Offered By The Contractor Meet The Requirements Described In The Swz, The Ordering Party Requires The Submission Of A Completed And Signed Annex No. 3 To The Swz - Product And Price Specification - Together With The Offer (In Accordance With The Principles Of Point 13.2 Of The Swz). 4/11.The Subject Of The Order Should Be Delivered By The Contractor In Packaging That Protects Against Damage And Contamination And Allows For Storage During The Warranty Period Specified By The Contractor Or Manufacturer.4.12.The Contractor Will Be Liable For Any Damage Caused To The Ordering Party Resulting From The Transfer Of The
