The Subject Of The Agreement Is The Purchase And Delivery Of Office Furniture To The Building Of The Oświęcim Commune Office, Ul. Zamkowa 4, 32-600 Oświęcim And Their Installation In The Rooms Indicated By The Ordering Party.2.The Furniture Delivered Must Be Brand New, Free From Defects, Bearing No Traces Of Use, Made In Accordance With The Design, A Detailed Description Of The Works Constituting Annex No. 2 To The Contract And A Price Form Constituting Annex No. 1 To The Offer Form, Which Will Constitute Annex No. 1 To The Contract.3.The Contractor Will Deliver The Subject Of The Order Using Its Own Transport, At Its Own Expense And Risk, To The Registered Office Of The Ordering Party, Where The Official Acceptance Of The Subject Of The Order Will Take Place. Delivery Also Includes Unloading And Assembly.4. Before Starting Production, The Contractor Is Obliged To Perform Accurate Measurements Of All Places Intended For Furniture Development, Taking Into Account Actual Dimensions, Slopes, Corner Angles, Uneven Walls, Floors And Existing Room Elements That May Affect The Production And Assembly Of Furniture.5. The Contractor, Together With The Offer Form, Is Obliged To Submit A Price Form - Annex No. 1 To The Offer Form, Which Will Constitute Annex No. 1 To The Contract.6.Rules For The Performance Of The Subject Of The Order, In Particular: 1) Obligations Of The Parties; 2) Participants In The Delivery Process; 3) Deadlines 4) Rules For The Execution And Settlement Of The Delivery; 5) Acceptance 8) Contractual Penalties; 9) Contractors Remuneration And Payment Rules; 10) Changes To The Contract; Are Specified In Detail In The Material Provisions Of The Agreement In Annex No. 8 To Swz7. The Ordering Party Requires A Minimum Warranty And Guarantee Period Of 60 Months Or A Maximum Of 72 Months For The Delivery8.Where A Trademark (Brand), Manufacturer, Supplier, Patent, Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor Is Indicated Or Standards, European Technical Assessments, Common Technical Specifications Or Other References Referred To In Art. 101 Section 1 Point 2 And 3, The Ordering Party In Accordance With Art. 99 Section 4 And 5 Of The Act Allows The Submission Of An Equivalent Offer Or In Accordance With Art. 101 Section 4 Of The Act, Offering Solutions Equivalent To Those Indicated In The Documentation, Provided That They Ensure Technical Parameters Not Worse Than Those Assumed In The Documentation.
