Electricity, Heating, Solar And Nuclear Energy – Purchase Of Electricity For The Needs Of Zakład Zadrożowania Odpadów Olszowa Sp. Z O. O.. 1. The Subject Of The Order Is The Implementation Of Supplies Entitled: Purchase Of Electricity For The Needs Of Zakład Za Gospodarowania Odpadów Olszowa Sp. Z O.O. In The Expected Amount Of 2,000.00 Mwh For The Indicated Off-Take Point, In The Period From January 1, 2027 To December 31, 2027, With The Notification Of The Change Of Supplier Taking Place No Later Than 3 Business Days From The Date Of Signing The Contract Between The Ordering Party And The Contractor And Receiving The Appropriate Powers Of Attorney. 2. The Sale Of Electricity Should Start On January 1, 2027. 3. The Ordering Party Informs That The Energy Consumption Forecast Indicated Above And In Annex No. 3 To The Swz (Offer Form) And In The Contract Template Are Only An Approximate Value, Which May Increase Or Decrease During The Execution Of The Ordering Partys Contract. Currently, The Ordering Party Is Unable To Predict The Exact Annual Electricity Consumption. The Actual Energy Consumption Will Depend Solely On The Actual Needs Of The End User, However, Regardless Of The Amount Of Consumption, The Contractor Is Obliged To Apply The Energy Prices Offered In The Tender In Each Case. The Contractor May Not Pursue Any Financial Claims (E.G. Compensation) From The Ordering Party If, During The Term Of The Contract, The Ordering Party Purchases From The Contractor A Smaller Or Larger Amount Of Electricity From The Contractor Than The Forecast One, Indicated In The Tor, In Particular Due To An Increase Or Decrease In The Expected Energy Consumption For The End User, A Change In The Tariff Group, A Change In The Ordered Power Or Technical Parameters Of The Energy Intake Point, Or The Actual Energy Consumption At The Energy Intake Point. 4. The Sale Of Active Electricity Should Take Place Under The Conditions Specified In The Provisions Of The Act Of April 10, 1997, Energy Law, In Accordance With The Applicable Regulations To The Above-Mentioned Act And The Provisions Of The Act Of April 23, 1964 - Civil Code, The Principles Specified In Licenses And Based On The Act Of September 11, 2019 - Public Procurement Law. 5. The Contractor Will Be Obliged To Submit An Effective Application On Behalf Of The Ordering Party To Conclude An Agreement For The Provision Of Distribution Services With The Manufacturer. The Ordering Party Informs That The Relevant Operator Is: Energa-Operator S.A. 6. This Should Be In Parallel With The Same Period As The Contract For The Purchase Of Electricity. 7. The Ordering Party Obliges The Contractor To Notify The Designated Distribution System Operator For The Implementation Of The Electricity Sales Contract Concluded With The Contractor, Submit Declarations Of Will And Determine On Behalf Of The Ordering Party All Necessary Activities Covered By The Law In The Scope Of The Implementation Of The Applicable Electricity Sales Contract And The Provision Of Distribution Services So That The Continuity Of Energy Supplies Is Ensured. 8. The Ordering Party Will Provide The Contractor Selected During The Public Procurement Procedure With Documents And Information Necessary To Carry Out The Seller Change Procedure. 9. Contractor Within The Scope Of The Contract
