System And Support Services – Providing Technical Assistance And Maintenance Services For The Stradom System. 1. The Subject Of The Order Is The Provision Of Technical Assistance And Maintenance Services For The Stradom System. A Detailed Description Of The Subject Of The Order Is Included In The Template Of The Agreement With Annexes, Constituting Annex No. 10 To The Terms Of Reference (Hereinafter: Swz). 2. In This Procedure, The Ordering Party Does Not Divide The Order Into Parts And Does Not Allow The Possibility Of Submitting Partial Offers: Subject Of The Order Entitled: The Provision Of Technical Assistance And Maintenance Services For The Stradom System, In The Opinion Of The Ordering Party, Due To Its Nature, Scope And Method Of Implementation, Constitutes An Indivisible, Coherent Whole, Which Justifies Not Dividing The Order Into Parts. The Scope Of The Order Includes Interrelated Activities Related To The Ongoing Maintenance Of The Stradom System, Technical Assistance And Ensuring The Proper And Safe Functioning Of The Stradom System. The Implementation Of These Tasks Requires Maintaining Uniform Technical, Organizational And Procedural Standards And Ensuring Clear Responsibility Of One Contractor For The Effect Of The Order Implementation. Dividing The Contract Into Parts Could Lead To Difficulties In Coordinating Activities, Dispersion Of Responsibility And, Consequently, To The Risk Of Reducing The Quality Of The Services Provided Or Disrupting The Continuity Of The System. For Economic And Organizational Reasons, Dividing The Contract Into Parts Could Also Result In An Increase In The Costs Of Contract Execution, The Need For Additional Coordination On The Part Of The Ordering Party And An Extension Of The Response Time To Notifications And Failures, Which Would Be Contrary To The Principle Of Effective And Rational Management Of Public Funds. Failure To Divide The Contract Into Parts Does Not Violate The Principles Of Fair Competition Or Equal Treatment Of Contractors And Does Not Limit Access To Orders For Micro, Small And Medium-Sized Enterprises. 3. The Ordering Party Does Not Require The Execution Of The Order By Sheltered Workshops, Social Cooperatives Or Other Contractors Covered By The Provisions Of Art. 94 Section 1 Of The Act. 4. The Ordering Party, Pursuant To Art. 95 Section 1 Of The Act Requires The Contractor (Or Subcontractor) To Employ, On The Basis Of An Employment Relationship, Persons Performing Work In The Field Of Telephone Consultations Referred To In Section 4 Of Annex No. 1 To The Template Agreement. Performing These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Consolidated Text: Journal Of Laws Of 2025, Item 277, As Amended). Attention! This Requirement Does Not Apply To Those Submitting Offers: Natural Persons Running A Business And Partners Of Partnerships Who Undertake To Personally Perform These Activities For The Company. 5. The Ordering Party Does Not Provide For The Possibility Of Awarding Contracts Referred To In Art. 214 Section 1 Point 7 Of The Act. 6. The Ordering Party Does Not Allow The Submission Of Variant Offers. 7. The Ordering Party Does Not Plan To Conduct An Electronic Auction. 7. The Ordering Party Did Not Conduct Preliminary Consultations Before Initiating The Procedure
