1. The Subject Of The Order Includes Successive Deliveries Of Dairy Products For The Needs Of Szpital Głogowski Sp. Z O.O.2.The Assortment, Estimated Quantities And Quality Requirements Regarding The Subject Of The Order Are Detailed In Annex No. 1 To The Swz - Assortment And Quantity Specification. The Terms And Conditions Of The Order Are Specified In The Draft Contract Constituting Annex No. 3 To Swz.3.The Subject Of The Order Is One Indivisible Task Covering 45 Product Items.4.Deliveries Of The Subject Of The Order Will Be Carried Out Successively, Depending On The Current Needs Of The Ordering Party, Based On Orders Placed By The Ordering Party.5.Deliveries Will Be Made From Monday To Saturday, From 6:00 A.M. To 6:30 A.M., Unless The Parties Agree On A Different Date For A Specific Delivery.6.Orders Will Be Placed By Phone Or Via E-Mail By Persons Authorized By The Ordering Party. The Order May Specify In Particular The Type, Quantity And Delivery Date Of The Ordered Products.7.The Ordering Party Reserves The Right To Purchase Smaller Quantities Of Individual Products Than The Quantities Indicated In Annex 1 To The Swz, In Accordance With The Current Needs Of The Ordering Party, Subject To The Minimum Level Of Order Fulfillment Guaranteed By The Ordering Party, Specified In The Draft Contract.8.The Ordering Party Guarantees The Execution Of The Order At A Level Not Lower Than 70% Of The Total Gross Value Of The Contract Specified In § 4 Section 1 Of The Draft Contract, Provided That The Limitation Of The Scope Of The Order Results From Circumstances Beyond The Control Of The Ordering Party, Which Could Not Have Been Foreseen At The Time Of Concluding The Contract.9.During The Execution Of The Contract, The Ordering Party May Make Quantitative Transfers Between Individual Product Items Specified In Annex No. 1 To The Swz, According To Current Needs, While Maintaining The Overall Gross Value Of The Contract And The Minimum Level Of Implementation Specified In Section 8/10.The Contractor Is Obliged To Ensure Continuity And Smooth Supply Of The Products Covered By The Contract Throughout The Entire Period Of Its Validity.11.The Delivered Dairy Products Must Be Fresh, Of Full Value, Free From Defects And Meet The Requirements Arising From Applicable Legal Regulations, In Particular Regarding Food Safety, Sanitary, Technological And Quality Requirements.12.The Delivered Products Must Have The Marking Required By Applicable Law, Appropriate For A Given Type Of Product, In Particular Regarding The Product Name, Data Of The Entity Responsible For Food Information, Net Quantity, Best-Before Date Or Date Of Minimum Durability And Storage Conditions - To The Extent Required By Law.13.Unit And Collective Packaging Of The Delivered Products Must Meet The Requirements Specified In Applicable Law And The Requirements Specific To The Given Type Of Product.
