1) The Subject Of The Order Is The Delivery Of A Brand New Agricultural Tractor, Manufactured In 2026, For The Implementation Of Civil Protection And Civil Defense Tasks In The Hyżne Commune. 2) The Vehicle Will Be Used To Remove The Effects Of Natural Disasters And Crisis Situations, In Particular To Remove Fallen Trees, Snow, Mud And Other Obstacles From Roads, Transport Equipment And Materials, As Well As Support The Activities Of Rescue Units. The Tractor Will Also Be Used To Clear And Prepare Access Roads, Enabling Emergency Services To Efficiently Reach Danger Sites And Other Locations Requiring Urgent Intervention, As Well As Ensuring Access For Technical Services Conducting Security Activities. The Need To Implement The Task Results From The Communes Experience With The Occurrence Of Violent Atmospheric Phenomena. 3) The Agricultural Tractor As Well As All Equipment Components Must Be Brand New, Unused, Unregenerated, Without Defects Or Damage And Meet The Requirements Resulting From Separate Regulations Regarding Their Use (If Applicable). The Contractor Is Responsible For Any Deficiencies And Defects In The Subject Of The Order. 4) The Contractor Undertakes To Deliver The Tractor Covered By The Subject Of The Order At His Own Expense To The Seat Of The Municipal Services Plant In Hyżne No. 628 With Transport Ensuring Proper Quality Protection Of The Delivered Goods Against Weather Factors And Damage, During The Plants Working Hours. Therefore, The Contractor Is Liable For Any Damage Occurring During The Transport Of The Delivered Item. Ownership Of The Vehicle Passes To The Ordering Party Upon Signing The Delivery And Acceptance Protocol And Physical Delivery Of The Vehicle To The Ordering Party. Until Then, The Contractor Is Responsible For The Vehicle. 5) The Delivered Vehicle Should Be Fully Functional And Meet The Quality And Technical Standards Resulting From Its Function And Purpose, In Accordance With The Specification Of The Order Conditions, And Should Be Free From Any Legal And Physical Defects. The Ordering Party Allows An Equivalent Delivery That Meets The Minimum Parameters And Requirements Described In The Swz.6) The Scope Of The Subject Of The Order Also Includes The Provision Of A Warranty Covering The Vehicle. A Warranty Period Longer Than 3 Years Will Be Scored.
