Bids Are Invited For Coltauco Municipal Parking Concession

The Municipality Of Coltauco Calls For Public Bidding To Contract, Parking Service And Removal Of Motor Vehicles From Public Roads, In Accordance With Law No. 18,290, With The Characteristic Of Sold Service, Lump Sum Contract, With Express Compliance With Current Regulations, In Accordance With These Administrative Bases, Technical Bases And Other Background That Is Part Of This Tender. In This Context, It Is Worth Remembering That The Administrative Jurisprudence Of The Comptroller Generals Office, Contained In Opinion No. 37,037 Of 1998, Has Specified That The Municipalitys Action Of Enabling And Maintaining Facilities Where Vehicles Removed From Circulation Are Transported In The Cases Indicated By Law No. 18,290, Implies The Provision Of A Service, Which Beyond Satisfying The Particular Interest Of The Person Affected By The Measure And Respecting Their The Right Of Ownership Over The Respective Personal Property Is Due To The Need To Serve The Community, Keeping Public Roads Clear. Then, The Authorization And Maintenance Of Places For The Storage Of Vehicles That Are Removed From Circulation In The Cases Ordered By The Traffic Law, Constitutes A Public Function That The Legal System Has Entrusted To The Municipalities In Their Respective Territories, And They Are Obliged To Comply With It, Either Directly Or Through A Concession To An Individual, Otherwise Their Actions Would Deviate From The Principle Of Legality, Enshrined In Articles 6 And 7 Of The Fundamental Charter And 2. Of Law No. 18,575, Constitutional Organization Of General Bases Of State Administration, According To Which State Bodies Must Submit Their Actions To The Constitution And The Laws, With No More Than Powers Other Than Those Expressly Conferred On Them By The Legal System (Applies Opinion No. 9,434, Of 2017).
