The Subject Of The Order Is The Winter Maintenance Of Roads, Squares, Sidewalks At Municipal Facilities And Stops In The Gierałtowice Commune In The 2026/2027 Season, Hereinafter Referred To As Zud, Consisting In The Performance Of Activities Aimed At Ensuring Passability And Limiting Disruptions To The Flow Of Road And Pedestrian Traffic Caused By Phenomena Such As Snowfall, Sleet, Freezing Drizzle Or Winter Slipperiness.2. A Detailed Description And Method Of Execution Of The Order Is Included In The Description Of The Subject Of The Order (Opz), Constituting Annex No. 7 To Swz.3. The Ordering Party Did Not Divide The Order Into Parts Due To Maintaining A Uniform Standard Of Road Maintenance In All Villages. If The Order Were Divided, Each Contractor Would Have To Have A Separate Base Of Equipment And Storage Of Road Sprinkling Materials, Such A Situation Would Be Uneconomical For The Ordering Party. Allowing More Than One Entity To Carry Out The Subject Of The Contract Would Make The Task Difficult For Organizational And Technical Reasons. Moreover, The Contract Is Suitable For Micro, Small And Medium-Sized Enterprises, So The Lack Of Division Of The Task Into Parts Does Not In Any Way Lead To Restriction Of Competition In The Procedure.4. Requirements Related To The Implementation Of The Contract In Terms Of Employment By The Contractor Or Subcontractor On The Basis Of An Employment Relationship Of Persons Performing Activities Specified By The Ordering Party In The Scope Of Contract Implementation, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code, Covers The Following Types Of Activities: 1) Due To The Specific Nature Of The Order, The Ordering Party Requires The Employment Of Persons (Manual Workers) Under An Employment Contract To Perform Activities Related To The Implementation Of The Order: A) Driver, B) Equipment Operator, I.E. Persons Performing Activities Related To The Operation Of Equipment To Perform The Order.5. Detailed Requirements Regarding The Implementation And Enforcement Of The Employment Requirement Based On An Employment Relationship Are Specified In The Draft Contract And The Description Of The Subject Matter Of The Procurement (Opz), Constituting Annex No. 6 And Annex No. 7 To The Swz, Respectively).
