1. The Subject Of The Order Is The Renovation Of Toilets In The Building Of The Municipal Primary School No. 13 In Piekary Śląskie.2. The Scope Of Construction And Installation Works Is Diverse And Includes General Construction, Plastering, Painting, Electrical And Installation Works.3. A Detailed Description Of The Subject Of The Order, Conditions Of Execution And Acceptance Of The Works Are Attached As Annex No. 1.1.A To The Swz - Specification For The Execution And Acceptance Of Works.4. The Ordering Party Attaches The Bills Of Quantities (Appendix No. 1.1 To The Swz) As Non-Binding Material. The Attached Bills Of Quantities Are Indicative And Should Be Treated As Supporting Material For A Quick And General Understanding Of The Material Scope And Size Of The Project. The Quantity And Description Of Individual Items Of The Bill Of Quantities Should Not Be Treated As Definitive.5. The Subject Of The Order Should Also Be Performed In Accordance With The Extract From The Technical Opinion Of The Building (Appendix No. 1.1.B To Swz) And In Accordance With The Chimney Sweepers Opinions (Appendix No. 1.1.C To Swz).6. The Conditions For The Execution Of The Order Are Included In The Draft Provisions Of The Contract Constituting Annex No. 2 To Swz.7. The Ordering Party Does Not Allow Construction Works To Be Carried Out On Two Floors At The Same Time, I.E. Construction Works Must Be Carried Out First On One Floor, And After They Are Completed And The Renovated Toilets Are Available, The Contractor May Start Construction Works On The Second Floor.8. The Contractor Is Obliged To Provide The Ordering Party With A 24-Month Warranty For The Completed Subject Of The Order, Counted From The Date Of Final Acceptance Of The Construction Works Being The Subject Of The Order.9. The Ordering Party Did Not Divide The Procedure Into Parts, Which Is Justified By Technical And Organizational Reasons - The Subject Of The Order Is Performed In One Location And Constitutes A Functional Whole. Dividing The Procedure Into Parts Would Result In The Need To Coordinate The Activities Of Various Contractors Implementing Individual Parts Of The Contract On A Small Area. This Would Create A Risk Of Avoiding The Liability Of The Contractors Due To The Difficulty In Clearly Determining The Causes Of Errors In The Works Performed - Which Seems To Be Possible In The Case Of Several Contractors Whose Total Effect Of Work Determines The Correct And Safe Performance Of Construction Works. In Relation To The Above, Further Division Of The Contract Into Parts Is Not Justified, As It May Lead To A Total Increase In The Costs Related To The Works Performed By The Contractors. Moreover, The Lack Of Dividing The Contract Into Parts While Simultaneously Carrying Out The Procedure In One Of The Competitive Modes Provided For In The Public Procurement Law - The Basic Mode - Does Not Restrict Competition And Ensures Equal Access For Entities From The Micro, Small And Medium-Sized Enterprises Sec
