Tenders Are Invited For Bemu Units In The Ústí Region – Plum Railway Ii.

The Contracting Authority Is Preparing The Procurement Of Four (4) New Bemu Railway Vehicles With Electric Battery Drive (Hereinafter Also Referred To As The Guaranteed Number And Vehicles) For The Purposes Of Their Future Use In The Provision Of Public Services In The Transport Of Passengers By Rail For The Ústí Region Within The Operational Set Of Bemu Units Of Švestková Dráha. For This Purpose, The Ústí Region Declared Its Intention To Conclude A Contract For Public Services In The Transport Of Passengers By Rail With The Contracting Authority For A Period Of 15 Transport Years, With An Expected Start Date From 2030 (With A Possible Postponement Of The Start Of Performance To 2032).The Technical, Qualitative And Safety Requirements For The Purchased Vehicles Are Based To A Significant Extent On The Requirements Set By The Ústí Region For Their Future Use In Ensuring The Transport Services Of The Region. The Contracting Authority Reflected These Requirements To The Appropriate Extent In The Terms And Conditions Of This Public Contract.In Connection With The Planned Procurement Of Vehicles And Their Future Use For The Provision Of Public Services For The Ústí Region, The Contracting Authority Intends To Seek Co-Financing Of The Vehicles Within The 2Nd Round Of The Call From The Transgov Program: Modernization Of Public Transport (Mof Call Number: Transgov No. 1/2024). The Contracting Authority Therefore (Potentially) Fulfills The Definition Of A Contracting Authority According To § 4 Paragraph 2 Of The Zzvz.With Regard To The Intended Co-Financing Of The Vehicles, The Contracting Authority Requires That The Participants In The Procurement Process Familiarize Themselves In Detail With The Conditions And Rules Of The Above-Mentioned Subsidy Program, Including The Conditions Of The Relevant Call, To The Extent Relevant To The Subject Of This Public Contract. Participants Are Obliged To Take These Conditions Into Account When Processing Their Offers And To Respect Them During The Subsequent Performance Of The Public Contract, If They Apply To Its Performance.The Public Contract Is Awarded In A Negotiation Procedure With Publication In Accordance With § 60 Zzvz, Because The Contracting Authority, Taking Into Account The Conditions Of The Tender Procedure, Has Come To The Conclusion That Its Specific Need Cannot Be Satisfied Without Adequate Adaptation Of Already Available Solutions On The Market And Due To The Complexity Of The Subject Of Performance, The Fact That The Technical Conditions Of The Subject Of Performance Cannot Be Sufficiently Defined Only By Reference To Technical Standards In The Sense Of § 90 Paragraphs 1 And 2 Of The Zzvz And Its Direct Link To The Conditions Tender Procedure, It Is Necessary To Conduct Negotiations With The Participants Of The Procurement Procedure.The Purpose Of This Above-Limit Public Contract For Supplies Awarded In A Negotiation Procedure With Publication In Accordance With The Provisions Of § 60 Et Seq. Zzvz Is The Conclusion Of A Contract For The Supply Of Vehicles Together With The Provision Of Service Services And Also The Possibility Of Exercising An Option Right Beyond The Guaranteed Number And To Extend The Period Of Service Provision, All In Accordance With Point 2.9 Of The Procurement Documentation.The Result Of The Procurement Procedure Will Be The Conclusion Of A Contract For The Performance Of A Public Contract With A Single Supplier.
