The Subject Of The Order Is The Purchase And Delivery Of Eco-Pea Coal For The Needs Of The Skomlin Commune In The 2026/2027 Heating Season In Bulk In A Basic Quantity Of 180 Tons. The Place And Volume Of Deliveries Are Specified In Annex 5 To The Swz, Which Is Also A List Of Payers. The Ordering Party Pursuant To Art. 31A Section 1 Point 3 Of The Excise Duty Act (Journal Of Laws Of 2026, Item 412), It Is Partially Exempt From Excise Duty On Coal Products, The Details Of Which Are Specified In Annex No. 5 To The Swz. Eco-Pea Coal Should Be Delivered Loose. The Ordering Party Does Not Allow Bagged Eco-Pea Coal. Eco-Pea Coal Should Be Of High Quality, Which Will Ensure Proper Operation Of Heating Devices And Will Meet The Quality Requirements Of Polish Standards And Meet The Following Parameters: 1) Calorific Value: Minimum 25 Mj/Kg2) Grain Size: 5-25 Mm3) Ash Content: Up To 5%4) Humidity: Up To 10%5) Sulfur Content - Up To 0.6% The Ordering Party Stipulates That The Parameters Of The Delivered Eco-Pea Coal Must Be Confirmed Upon Delivery With A Current Certificate Or Solid Fuel Quality Certificate. The Contractor Will Deliver Eco-Pea Coal Using Its Own Transport And At Its Own Expense. The Ordering Party Will Not Bear The Costs Related To The Transport And Unloading Of The Delivered Eco-Pea Coal. The Contractor Undertakes To Perform The Subject Of The Contract Properly, In Accordance With The Adopted Standards And Regulations, And In Particular To Timely Deliver Full-Value Eco-Pea Coal. The Contractor Will Pay The Ordering Party For Losses Resulting From Documented Damage To The Boiler Room Equipment As A Result Of The Contractor Delivering Eco-Pea Coal With Quality Inconsistent With The Parameters Specified In Point 4.4 In The Amount Of The Damage Suffered. The Delivery Of Eco-Pea Coal Will Be Collected By Employees Of The Skomlin Commune Office. A Certificate Or Certificate Of Solid Fuel Quality Is A Necessary Condition For Accepting The Delivery. The Contractors Employee Is Obliged To Provide The Certificate Or Certificate Of Solid Fuel Quality And The Delivery Document Confirming The Amount Of Eco-Pea Coal Delivered (Wz) To The Person Authorized By The Ordering Party To Receive The Delivery.
