A Detailed Description Of The Subject Of The Order Is Included In Annex No. 1 To The Swz - Description Of The Subject Of The Order. 4. The Ordering Party Does Not Impose Any Restrictions As To The Origin Of The Contractor Or The Subject Of The Order In Terms Of Market Availability And Participation In This Procedure. 5. The Ordering Party Does Not Allow The Submission Of Partial Offers. The Subject Of The Order Constitutes One Functionally And Technologically Coherent Project. Individual Elements Of The Order Are Closely Related And Interdependent. In The Ordering Partys Opinion, The Lack Of Division Of The Order Into Parts Does Not Restrict Competition, But Ensures Correct, Timely And Safe Execution Of The Order. 6. Pursuant To Art. 226 Section 1 Point 19 Of The Public Procurement Law, The Ordering Party Rejects The Offer If It Includes An Ict Product, The Type Of Which Was Specified In The Decision On Recognizing The Supplier As A High-Risk Supplier, Referred To In Art. 67B Section 15 Of The Act Of 5 July 2018 On The National Cybersecurity System, Or An Ict Service, Or An Ict Process, Specified In This Decision. 7. The Ordering Party Does Not Allow The Submission Of Variant Offers. 8. The Ordering Party Allows The Submission Of Equivalent Offers. Equivalent Solutions: 8.1. In Each Case Of Using Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, The Contractor Should Assume That Such A Reference Is Accompanied By The Words Or Equivalent. 8.2. The Contractor Who Invokes An Equivalent Solution Is Obliged In Accordance With Art. 101(5) Of The Public Procurement Act, Prove In The Offer That The Solutions Proposed By Him Meet The Requirements Specified By The Ordering Party In The Description Of The Subject Of The Order To An Equivalent Extent. In Such A Case, The Contractor Attaches To The Offer A Method Of Demonstrating Equivalent Solutions Along With Its Description Or Standards Confirming That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Order. 8.3. In The Event Of The Ordering Partys Doubts Related To Determining The Equivalence Of The Submitted Offer, All Obligations Related To Proving That The Solutions Proposed By The Contractor Equally Meet The Requirements Specified By The Ordering Party In The Description Of The Subject Of The Order Rest With The Contractor. 8.4. If The Subject Of The Contract Is Described By Indicating Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, And The Ordering Party Cannot Describe The Subject Of The Contract In Sufficient Detail
