1. The Subject Of This Order Is The Successive Delivery Of Construction Materials For The Purposes Of Construction Works Carried Out By The Ordering Party. The Ordering Party Will Provide A Delivery Schedule With An Indication Of The Date And Place Of Delivery Along With Design Documentation For Specific Construction Works, And The Supplier Will Provide Construction Materials In Accordance With The Design Documentation Provided By The Ordering Party And Within The Time Guaranteed In The Offer. Construction Materials Should Be Transported By Appropriate Means Of Transport, Adapted For This Purpose, In A Way That Guarantees The Avoidance Of Permanent Damage And In Accordance With Occupational Health And Safety And Road Traffic Regulations. The Ordering Party Reserves The Right To Fulfill Orders For Goods In Quantities Depending On Its Actual Needs, And The Quantity To Be Fulfilled Is Not Less Than 90% Of The Value Of The Subject Of The Order. The Quantitative Scope And General Requirements Are Included In The Table - Detailed Description Of The Order. 3. Settlement Of Deliveries Will Be Made According To The Theoretical Weight Of The Supplied Reinforcing Steel In Accordance With The Wz.4 Document. A Detailed Description Of The Subject Of The Order And The Terms Of Delivery Are Specified In: 1) Product And Price Form - Annex No. 1.A To The Swz, 2) Designed Provisions Of The Contract That Will Be Introduced Into The Content Of The Contract - Annex To The Swz. All Requirements Specified In The Documents Indicated Above Are Minimum Requirements And Their Fulfillment Is Obligatory. Failure To Meet The Above-Mentioned Minimum Requirements Will Result In Rejection Of The Offer As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law5. By Equivalent Solutions, The Ordering Party Understands Those That At Least Meet The Requirements Specified In The Terms Of Reference And Are Characterized By Quality And Performance Parameters Not Worse Than Those Specified In The Description Of The Subject Of The Order. The Contractor Who Offers Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Attach To The Offer A List Of All Offered Equivalent Solutions And Demonstrate Their Equivalence In Relation To The Solutions Described In The Tender Documentation, Indicating The Name And Item Description Of The Subject Of The Contract To Which It Applies.
