Refuse Collection Services – Municipal Waste Management - Collection And Management Of Municipal Waste From Inhabited And Uninhabited Properties In The Namysłów Commune. The Subject Of The Order Is Municipal Waste Management - Collection And Management Of Municipal Waste From Inhabited And Uninhabited Properties In The Namysłów Commune. A Detailed Description Of The Subject Of The Order Is Attached As Annex 3 To The Swz. Option Right: 1. The Ordering Party Informs That When Implementing The Subject Of The Order, It Envisages The Possibility Of Using The Option Right Pursuant To Art. 441 Section 1 Of The Public Procurement Law, Which Will Consist In: A) Extending The Contract Implementation Deadline By A Maximum Of 3 Months In The Event Of Failure To Select A Contractor For The Task Entitled Municipal Waste Management - Collection And Management Of Municipal Waste From Inhabited And Uninhabited Properties In The Namysłów Commune For 2027, For Reasons Beyond The Control Of The Ordering Party, In Particular In The Event Of Filing A Legal Remedy Under The Principles Provided For In The Public Procurement Law; B) Increasing, During The Term Of The Contract, The Estimated Amounts Of Waste To Be Collected And Transported As Well As The Management Of Individual Types Of Waste And The Weight Of Actually Transported Types Of Waste, But Not Resulting In An Increase In The Value Of The Contract By More Than 15% In Relation To The Value Specified In § 6 Section 1 Of The Contract. The Value Of The Optional Order Will Be Related Each Time To The Value Specified In § 6 Section 1 As At The Date Of Conclusion Of The Contract, Regardless Of Changes And Updates Of This Value During The Term Of The Contract. 2. If The Ordering Party Exercises The Option Right, The Contractor Is Entitled To Remuneration For The Actual Quantities Of Services Performed Under The Concluded Contract, Constituting The Sum Of The Products Of The Gross Unit Price For Collection, Transport And Management Of Individual Types Of Waste And The Weight Of Actually Transported Types Of Waste. 3. The Option Right Is Described In The Draft Contract - Annex No. 2 To The Swz. 4. The Option Right Is A Unilateral Right Of The Ordering Party, Which He May, But Is Not Obliged To Use, As Part Of The Implementation Of The Subject Of The Order. If The Ordering Party Fails To Exercise The Option Right, The Contractor Shall Not Be Entitled To Any Claims In This Respect. Activation Of The Option By The Ordering Party Results In The Contractors Obligation To Execute It. 5. If It Is In The Interest Of The Ordering Party And Concerns Its Current Needs, The Ordering Party Reserves The Right To Repeatedly Exercise The Option Right Until The Options Provided For By Law Are Used. 6. In Order To Activate The Option, The Ordering Party Will Provide The Contractor, In Writing, With A Declaration Expressing The Will To Exercise The Option Right, No Later Than 10 Days Before The Planned Completion Of The Contract Or No Later Than 40 Days From The Collection Of Waste And Transport And Management Of Individual Types Of Waste And The Weight Of Actually Transported Types Of Waste, With A Value Constituting 95% Of The Contract Value Specified In § 6 Section 1 Of The Contract. 7.
