Computer Equipment And Supplies – 2026-0150, Procurement Of Server Hardware For The Control Center Of The Fire Department Of The City Of Leverkusen, Edith-Weyde-Str. 12, 51373 Leverkusen (New Tender Of Award No. 2025-0149). The Contractor Sells The Hardware To The Client In Accordance With The Agreements In The Contract And Gives The Client Ownership Of It Upon Delivery. In Accordance With The Legal Requirements, The Contractor Takes Over The Disposal Or Recycling Of The Packaging And, At The Request Of The Client, Also Of The Delivered Hardware Or Parts Thereof After Their Respective End Of Use, Without Separate Remuneration, Unless Otherwise Agreed (E.G. Remuneration For Disposal). The Disposal Or Recycling Must Be Carried Out Professionally. Disposal By The Contractor Must Be Carried Out In Such A Way That Stored Data Is Neither Readable Nor Reconstructable. The Client Is Entitled To Remove Parts Of The Hardware For Disposal Before Collection. The Hardware Documentation Must Be Delivered In German And In Printed Or Printable Form, Unless Otherwise Agreed. The Contractor Delivers The Hardware Free Of Any Software* That Could Cause Damage, E.G. In The Included Drivers Or Firmware. This Must Be Checked In An Appropriate Manner At A Reasonable Time Before Delivery. The Contractor Declares That The Test Revealed No Evidence Of Software* That Could Cause Damage. This Regulation Applies To Everyone, Including Provisional And Advance Release, E.G. For Testing Purposes. The Contractor Also Guarantees That The Hardware To Be Delivered Is Free Of Functions That Jeopardize The Integrity, Confidentiality And Availability Of The Hardware, Other Hardware And/Or Software Or Data And Thereby Run Counter To The Confidentiality Or Security Interests Of The Client Through Functions For The Unwanted Transfer/Rejection Of Data, Functions For The Unwanted Change/Manipulation Of Data Or The Flow Logic Or Functions For The Unwanted Introduction Of Data Or Unwanted Function Extensions. A Possible Activity Of A Function Is Undesirable If The Activity Was Neither Requested By The Client In Its Service Description, Nor Offered By The Contractor With A Specific Description Of The Activity And Its Effects, Nor, In Individual Cases, Expressly Authorized (Opt-In) By The Client. If The Installation* Of The Hardware Has Been Agreed By The Contractor, This Will Take Place On The Delivery Date, Unless Otherwise Agreed. If The Pre-Installation* Of Operating System Software Has Been Agreed, The Installation Will Take Place In Accordance With The Respective Manufacturer Specifications, Unless Otherwise Agreed. The Contractor Informs The Client Of Any Usage Blocks* That Could Affect The Use Of The Hardware. If The Hardware Is Subject To Export Control Regulations, The Contractor Will Indicate This In The Contract. The Client Is Responsible For Ensuring Proper Data Backup*.
