1. The Subject Of The Order Is The Execution, In The Design And Build Formula, Of Construction Works Entitled: Construction Of Home Sewage Treatment Plants In The Domaszowice Commune. The Procedure Is Carried Out As Part Of The Strategic Plan For The Common Agricultural Policy For 2023-2027, Intervention I.10.10 Infrastructure In Rural Areas And Implementation Of The Concept Of Smart Villages, Area A Investments In The Field Of Individual Sewage Treatment Systems. A Detailed Description Of The Subject Of The Order Is Attached As Annex No. 3 To Swz2. Codes And Names According To The Common Procurement Vocabulary (Cpv): Main Cpv Code: 45000000-7 Construction Worksadditional Cpv Codes:45200000-9 Construction Works In The Field Of Construction Of Complete Buildings Or Parts Thereof And Civil Engineering Works45230000-8 Construction Works In The Scope Of Construction Of Pipelines For Communication And Power Lines, Highways, Roads, Airports And Railways; Land Leveling45231000-5 Construction Works In The Field Of Construction Of Pipelines, Communication Routes And Power Lines45231300-8 Construction Works In The Scope Of Construction Of Water Pipelines And Sewage Disposal Pipelines45252127-4 Construction Works In The Field Of Sewage Treatment Plants,71322000-1 Design Engineering Services In The Field Of Civil Engineering3. The Contractor Is Obliged To Complete The Order On The Terms And Conditions Described In The Swz Together With Annexes And The Offer.4. The Ordering Party Does Not Divide The Order Into Parts. The Value Of The Order Is Lower Than The So-Called Eu Thresholds That Oblige To Implement Eu Directives. Directive 2014/24/Eu States In Recital 78 That, In Order To Increase Competition, Contracting Authorities Should In Particular Be Encouraged To Divide Large Contracts Into Lots. The Contract In Question Is Not A Large Contract Within The Meaning Of Recital 78 Of The Above-Mentioned Eu Directive (The Directives Apply From The So-Called Eu Thresholds, And The Directive Uses The Concept Of A Large Contract In The Context Of Contracts Subject To The Directive, I.E. A Contract With A Value Significantly Exceeding The So-Called Eu Thresholds). The Contract Was Not Divided Into Parts For The Following Reasons: Contractors Would Duplicate Indirect Costs Of Works, Which Would Affect The Investment Costs. In Each Partial Offer, The Contractor Would Have To Provide A Separate Valuation For The Use Of The Same Type Of Equipment In A Situation Where, When Submitting One Offer, The Contractor Would Price The Use Of The Equipment Once. Each Contractor Would Include Separate Costs Of Third Party Liability Insurance In The Price, Which Would Increase The Level Of The Ordering Partys Expenses. If Divided Into Parts, Contractors Would Duplicate Costs, Including: Supplies Of Materials Necessary For The Implementation Of The Investment, Costs Of The Construction Process Management Staff, Costs Of Preparing Documentation Or Surveying Services, Which Would Adversely
