A Detailed Description Of The Subject Of The Order Is Specified In Chapter Ii And Constitutes An Annex To The Specification Of Procurement Conditions (Hereinafter Referred To As Swz Or Specification).4. The Ordering Party Does Not Allow The Submission Of Variant Offers.5. Accessibility Requirements For People With Special Needs, Including People With Disabilities, Pursuant To Art. 100 Paragraph 1 Of The Public Procurement Law And The Act Of July 19, 2019 On Ensuring Accessibility For Persons With Special Needs, Are Specified In Chapter Ii Of The Swz - Description Of The Subject Of The Order.6. Pursuant To Art. 95 Section 1 Of The Public Procurement Law, The Ordering Party Requires Employment By The Contractor Or Subcontractor On The Basis Of An Employment Relationship, Within The Meaning Of Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code, Persons Performing The Activities Indicated Below In The Implementation Of The Subject Of The Contract, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Labor Code. 7. The Requirement Of Employment On The Basis Of An Employment Relationship Applies To Persons Performing The Following Activities As Part Of The Subject Of The Order: 1) Preparation And Ongoing Service Of Hotel Rooms Intended For Conference Participants, Including Cleaning Activities Related To The Preparation And Maintenance Of Rooms, 2) Hotel Reception Services Related To The Accommodation And Stay Of Conference Participants, 3) Preparation Of Meals Covered By The Subject Of The Order, Performed By The Kitchen Staff, 4) Catering Services For Conference Participants, In Particular Preparation Of The Room, Serving Or Serving Breakfasts, Lunches, Dinners And Gala Dinners, 5) Preparation, Ongoing Service And Supplementation Of Coffee Breaks, 6) Ongoing Cleaning Services Of Conference Rooms, Catering Rooms And Other Rooms Used Directly For The Execution Of The Subject Of The Order. 8. The Requirement Of Employment Under An Employment Relationship Does Not Apply To Persons Performing Activities Whose Method Of Performance Does Not Meet The Conditions Specified In Art. 22 § 1 Of The Labor Code, In Particular Persons Running A Business And Personally Performing The Activities Entrusted To Them Independently, Without Being Under The Employers Supervision At The Place And Time Designated By The Employer. 9. The Requirement Specified In This Point Applies To Both Persons Employed Directly By The Contractor And Persons Employed By Subcontractors Participating In The Execution Of The Order. The Contractor Is Obliged To Ensure Compliance With The Above Obligation By Subcontractors. 10. The Obligation To Employ Under An Employment Relationship Applies Throughout The Entire Period Of Performance Of The Activit
